Kenneth Chamberlain, Sr., a 68-year-old African-American Marine veteran, was fatally shot in November by White Plains, NY, police who responded to a false alarm from his medical alert pendant. The officers broke down Chamberlain’s door, tasered him, and then shot him dead. Audio of the entire incident was recorded by the medical alert device in Chamberlain’s apartment.

Update 1
An autopsy report from the Westchester Medical Examiner’s Office shows that Kenneth Chamberlain Sr. was legally drunk when he was shot and killed by a White Plains police officer, but also shows that he could not have been trying attack police who responded to his apartment on a medical assistance call, a lawyer for the Chamberlain family said today.

There's something really messed up about this, besides the obvious. The police were there to theoretically save him from a heart attack, yet they were calling him racist things through the door while he told them to leave? Why didn't he just let them in to satisfy them that their services were not needed. After all, he was the one who pressed the button on the alert pendant. There's no reason not to let them in and be rid of them, much less put up what was apparently a huge fight when they took the door off the hinges.

Also, why did the police press the issue when the man was obviously quite well? Nothing is adding up here.

Indeed, he could've just opened the door and let them know he was ok. However, according to his son, his father said before the police got through the door that they were going to kill him. It would be very interesting when the video and audio of the incident is released. I believe the medical company has the entire incident recorded.

Another interesting fact is that the medical company hearing the commotion called the police department to cancel the call, saying that the man was alright. The police department said they weren't cancelling it.

Very odd.

How would a 68-year old man in his condition be able to 'charge' the officers with a knife, after being tazered and bean-bagged like that?

Without the audio and video, none of the news sources should be trusted. This is just more sensationalism.

But yeah, I'd have trouble trusting Democracynow, even with the audio and video.

The video and audio recordings will tell the truth about what happened.

Until then.. I urge anyone not to jump to conclusions based on what the media has decided to report.

Good. It's nice to hear that some aspects of our government are doing their part to promote our nation's economic recovery.

Glad this story is finally picking up steam. It was on the local news a few months ago and no one gave a crap.

I am sure they'll get off anyway.

Local news have mentioned that the officers pieces of shit said to "turn off the camera" moments before killing him.

WHITE PLAINS — Public Safety Commissioner David Chong confirmed today that city Police Officer Anthony Carelli fired the shots that killed 68-year-old Kenneth Chamberlain Sr. during a standoff at Chamberlain’s apartment in November.

Chong said that information, along with all evidence gathered by police, has been turned over to the Westchester District Attorney’s Office, which is preparing to present the case to a grand jury.

“The White Plains Department of Public Safety has cooperated fully with the Westchester County District Attorney’s office in their investigation,” Chong said in a statement, which says the DA’s office was notified shortly after the shooting and responded to the scene.

“Within a matter of days the Public Safety Department was advised that this matter would be presented to a grand jury,” the statement says. “The department has turned over all evidence in its possession to the District Attorney’s office. We are confident that the presentation to the grand jury will be thorough. Given the pending nature of the presentation we will have no other comment until the grand jury completes its investigation and the findings are made public.”

Police had not released the name of the officer who shot Chamberlain until today despite repeated calls from his family to do so.

Carelli joined the department in 2004. Chong would not say whether he has been assigned to desk duty since the Nov. 19 shooting. The incident has been receiving widespread media attention in recent weeks following the Feb. 26 Trayvon Martin shooting in Florida.

A former Marine and retired corrections officer, Chamberlain was killed at his 135 S. Lexington Ave. apartment by officers who responded after family members said his medical alert device accidentally went off. The family said Chamberlain told police that he was OK and that there was no emergency and the medical alert company called to cancel the alarm, but officers insisted that Chamberlain let them in to make sure everything was all right.

Police said Chamberlain was emotionally disturbed and screaming and tried to attack them with a hatchet and a knife and was shot with a stun gun and beanbags before an officer shot him with his handgun. The family says that audio and video recordings shown to them by DiFiore's office tell a different story. Chamberlain Jr. said his father was unarmed, with his hands by his sides when police broke down his apartment door and immediately shot him with a stun gun.

The family has repeatedly called for police to name the officer who shot Chamberlain and said they want him charged with murder. The family has also filed a notice of claim announcing their intention to sue the city.

DiFiore met with Chamberlain Jr. and his lawyers last week and assured them that all evidence in the case will be presented to a grand jury.

Chamberlain Jr. and his lawyers were not immediately available for comment this morning.

With so many stories of cops being pieces of shit, I really don't feel bad when stories come out of the tables being turned on them. Female family member of mine is a Chicago cop, young too, barely 30 years old. She's an admitted racist (though married to a Latino) and after meeting some of her coworkers, can definitely see they all have the same mentality.

This is why we need to a gun ban in this country. Too many people who don't know how or when to use their weapons killing people in their own homes.
