A good friend of mine is a Major in the 82nd. Talked to him on Facebook about this and that soldier is in some deep doodoo with the army.

if that was the army's, how did he get it off base?

Strictly speaking, if this is accurate, I'm not sure it was illegal despite the arrest.
Statute

This is a common law offense. State v. Dawson, 272 N.C. 535, 541-42 (1968); State v. Huntly, 25 N.C. 418, 418 (1843); State v. Staten, 32 N.C. App. 495, 496-97 (1977) (citing Dawson).

Elements

A person guilty of this offense

(1) arms himself or herself with an unusual and dangerous weapon

(2) for the purpose of terrifying others and

(3) goes about on public highways

(4) in a manner to cause terror to the people.

Punishment

Class 1 misdemeanor. G.S. 14-3(a).
 
And why a LOADED weapon, if he just wanted photos?

Edit: I just read the article, and it sounds like Wolfinger was carrying clips loaded with live ammo. But it's not clear from the report whether or not Wolfinger had put a loaded clip in the rifle.

Not to nit pick, but a pet peeve of mine. They called magazines not clips.

He was probably full auto as well.

Unless modified and from the Amry armory, its single or three round burst, not full auto capability.

Normally, when you buy a gun it comes in a box of some sort and is NOT LOADED. You can go to any airport with a firearm in a locked box and take it with you on the plane, not in the cabin but in the cargo area. But, don't try to do that with a LOADED WEAPON!

OK, now in what way is buying a gun and walking out with it in its box UNLOADED the same as walking around with the same weapon in your hands or over your shoulder LOADED?

I think the same thing when someone votes democrat.
You can exercise your rights by going into public, punching yourself in the testicles, and then vomiting on yourself.

It doesn't change the fact that it's a dumb ass move and likely to get the attention of the police.

Not to mention, the Army may perhaps be upset with his behavior. I mean, sure, the Army and the military in general is the very definition of socialism, but even so, I think its important that ye olde Army isn't particularly happy with his behavior. Or to put it another way, even if what he did was legal, it was...a dumb ass move.

Nothing! You'd then need to open a box of ammo, load a magazine, load magazine into weapon, and then you're ready to go.

You could also do this at an airport but odds are by the time you were ready to rock-and-roll you'd be dead.

One more thing ... I have never seen a gun store INSIDE a mall, generally they're in separate buildings or in strip malls -- I've never seen one in an actual mall but then I haven't been everywhere in Texas soooo...

Yeah, I'm probably a bit older than you are. I remember going into mall stores and seeing the guns next to the tennis rackets.

But anyway, for the overall thread, people need to mellow out at the sight of a gun.

With all the stuff going on with isis we do not want terrorist over here. Anyone wearing an Islamic symbol sho0uld be treated as a terrorist?

That aroused my curiosity enough to hit Google.

I have no idea of how you got from my rhetorical statement of someone expressing their rights and being a dumb ass at the same time, to Jews wearing a star of David in public, or Mooselmans wearing a crescent moon and star in public.

That said, nice job missing the point!

Look, if you want to walk around like a super hotshot with your loaded rifle in public, and it isn't illegal, go for it.

But, don't expect that you won't be drawing attention from law enforcement, and if it's against military regulations and you're, uh, in the military, don't expect that your employer isn't going to be upset with you over your actions in, you know, violating regulations or standards of conduct.

This doesn't seem like a partisan issue to me. Of course, I won't be walking around with a loaded weapon in public, so perhaps I just don't understand the severe oppression J̶e̶w̶s̶ ̶ ̶M̶o̶o̶s̶e̶l̶m̶a̶n̶s̶ US Military personnel suffer on a daily basis.
