Very little about human interaction is black and white. It is almost always a shade of gray. That is why we need jury and judges. The devil is always in the details.
That is why the 'What if they were both drunk' argument doesn't work, it is a stupid question dressed up to sound nice. The the truth always resides in the details. Being drunk is just one of many factors.
