I get it if a drunk woman actively consented and was conscious the whole time. But her passing out is not giving consent, and if she passed out in the middle of sex consent ends.

This seems like a bat shit law.

Actually, this odd one of those cases where I blame the lawmakers and not the judge. Hopefully this provides further impetus to get the law changed.
 
Just putting this out there, dont kill me... There is this tiny possibility that she had given consent but forgotten about it. @Heavy drinking some people black out and then come to in the middle of some action. I am not saying that is the case here, but it does raise the question, what if I dont remember what "autopilot me" was doing while I was "away from keyboard"? Only real solution I can come up with is to wear a recording device at all times, all day all week. (if you dont already.. you never know when that comes in handy)

Right. But how drunk is that? As in how do you measure it?
Some countries have rules about “verbal consent”... But if no one remembers the tree falling did it make a consent? Maybe there was regret? Keep a record is what I say.

Well I know one thing for sure, alcohol is the national pastime in Minnesota. They love their booze. I suspect its the harsh Winters, I mean really harsh Winters. If they didn't drink, and drink a lot, they'd all freeze to death. So this judge doesn't surprise me. They can call it THE KAVANAUGN RULE.

Yet, we never talk about how men shouldn't put themselves in bad situations. Don't want to be accused of date rape? Don't fuck girls that are out of their mind drunk and don't have one night stands while you are drunk out of your mind.

I am opposed to having sex with unconscious women. You miss out on all the sobbing moaning and screaming telling you when to accelerate and when to put on the breaks. But I suppose in a motel room it keeps the people in adjacent rooms from pounding on the wall.

Khali woke up to find the woman he’d been drinking with was using the credit card tied to the small business he owned to buy $1000’s of online merchandise.

Minnesota is one of the many states that says that for a victim to be too mentally incapacitated to give consent, they must have become intoxicated against their will, such as if a person secretly drugged someone's drink.

Since Khali had willingly drank 5 drinks before going home with her the judges ruled he had given consent to the purchases.

Would you have an issue with a law that allowed that?
