Iraq may have executed some US prisoners

Some of the US army soldiers captured over the weekend near the southern town of Nasiriya may have been executed by their Iraqi captors, possibly in front of townspeople.

Footage of five prisoners and seven dead soldiers -- mechanics with the US Third Infantry Division who apparently got lost in the desert and were ambushed by Iraqi forces -- was broadcast on the Qatar-based Al-Jazeera television network on Sunday.

The footage, provided by Iraqi state television, showed at least four bodies, some apparently with shots to the head.

US officials told the New York Times that the information was based on a sole communications intercept, and that they were attempting to confirm the information.

"When the full story comes out, people will be outraged," a senior US official told the Times.

al-queda do not meet the requirements of the geneva convention, sorry, they are not part of a state sponsored military force, they do not fight in uniform.

I think the Geneva convention is more ambiguous than that:

I'm always hearing about the "spirit" of 1441 in that "serious consequences" meant "war" and required no further debate. Well, IMHO the "spirit" of the Geneva Convention applies in this case (and would probably be ammended as such if it were rewritten today). This is a new kind of warfare - but its still warfare.

To quote Article 1:

In addition to the provisions which shall be implemented in peace time, the present Convention shall apply to all cases of declared war or of any other armed conflict which may arise between two or more of the High Contracting Parties, even if the state of war is not recognized by one of them.

It could well be argued that a war on terrorists has been delclared.

To quote in part Article 3:

1. Persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed hors de combat by sickness, wounds, detention, or any other cause, shall in all circumstances be treated humanely, without any adverse distinction founded on race, colour, religion or faith, sex, birth or wealth, or any other similar criteria.

On this criteria you could argue that the prisoners in camp X-ray are covered by the Geneva Convention. I don't think that "including" means "excluding all others" in this case.

Yes - other parts of article 3 state:

A. Prisoners of war, in the sense of the present Convention, are persons belonging to one of the following categories, who have fallen into the power of the enemy:

1. Members of the armed forces of a Party to the conflict as well as members of militias or volunteer corps forming part of such armed forces.

2. Members of other militias and members of other volunteer corps, including those of organized resistance movements, belonging to a Party to the conflict and operating in or outside their own territory, even if this territory is occupied, provided that such militias or volunteer corps, including such organized resistance movements, fulfil the following conditions:

and so I can see a counter arguement - but to paint it black and white is IMHO deceptive at best. I can believe that if rewritten in a modern context the convention would encompass those at X-ray specifically - it was just probably not considered back in 1949.

I would be quite happy to continue this discussion in the "merits of war forum".

This is a good thing, relatively speaking of course.

When the republican guard was dug in and camoflaged it was hard to spot them and target them. But now that they're on the move in a massive convoy heading towards our troops, they are exposed. Remember the "highway of death" in the first Gulf War? That is what happens when you try to move a large column of vehicles when your enemy has control of the air. You can bet your as* that we're cluster bombing that convoy to oblivion right now. I'd be surprised if any significant number of vehicles reaches our troops.

Welcomt to AT, great observation. This convoy has not been confirmed, but there are also reports of busload of civilians being placed in line with tank columns, if this happens in this case and they show up with equal numbers of innocent civilians what should we do?

An elite republican guard division with a convoy of 1,000 vehicles is headed towards the Marines 1st Expeditionary Force that recently struggled past Nasiriyah. Can that one Marine division handle them alone or are they sitting ducks without heavy air support? If they have air support why isn't that convoy of 1,000 now 50 already?

We were supposed to have an entire armored division converging on Baghdad from the North to keep pressure of guys in the South. Turkey wouldn't let them through and now they're gonna be tied up in canals and the Red Sea for another couple weeks. In my eyes, that's 100x worse than what France and Germany and Russia have done. Their actions have DIRECTLY put US military lives at risk and if anybody deserves a dehabilitating boycot, it's Turkey not France.

The convoy of 1000 vehicles is probably half comprised of pickup trucks.

they are also one of our oldest allies and allowing overflights to give us the chance to airlift troops and equipment to the north..

The weapons those countries you listed sold illegal waepons to Iraq that are more deadly to american forces than having to adjust our battle plan.

this convoy has not been confirmed has it? if it hasnt by now I would doubt its existence...
