According to my sources, it should come at any moment. Judge Whyte has stated that he wants to send his Hynix judgement to the CAFC (U.S. Court of Appeals - DC Circuit), so that the appeals court can compare his findings versus the adverse ruling that was handed down by Judge Robinson from Delaware. Since Judge Robinson wrote the finalizations of her case already, Judge Whyte needs to do it within 30 days of hers (the length of time Rambus can appeal Delaware). I don't have my papers with me, but I think it has to be before March 10th? Keep in mind, Judge Whyte asked Rambus which was more important to them; the finalization of Hynix or continuing the DDR2 case as he doesn't have the resources to do both in a timely manner. Rambus chose Hynix. I don't see the judge going past that date.
What intrigues me is he told Rambus and Hynix to meet before he finalizes his ruling. I'm not sure why? It's possible that Rambus and Hynix knows to an extent the damages and remedy he is awarding Rambus, and given Hynix's financial concern, is giving them a chance to settle on some terms beforehand? Who knows what they're doing, but that was one of the possibilities thrown out there.
There's 2 other important dates...
One is this upcoming Monday, where the Supreme Court will decide if they will hear the FTC's case against Rambus, deny to hear it at all or ask the surgeon general for his advice. This is the FTC's last chance, as the appeals court ruled unanimously not to hear it. We should know sometihng by 10am Monday on this.
Second, since DDR2 is on hold until at least May 2009 (when Judge Whyte will ask for status), or later than that once the CADC rules, the most important trial is the antitrust. Judge Kramer is slated to start in April. There's a few case management conferences at the end of this month that should confirm this. The hope hear is that it is not delayed. No delay means pressure on all sides to settle before the DDR2 starts. There's a lot of damaging documents in this.
