Hey, GE is under $10 too. I never thought THAT could happen last year.

I remember when it was hovering around the $40's and crashed when they announced a a big earnings hit last year in April. I bought around $32 and it was creeping up until the financial mess hit full speed. I sold out at $22 or so and bought more RMBS. That was genius until January 9th of this year.

C'est la vie.

I bought an additional 1,000 shares of RMBS in the low $6's. This feels eerily similiar to when RMBS followed the market down hard and hit their November 2008 lows.

They're all coming out and saying nationalization is off the table. Which I interpret as... BAC and C will definately be nationalized.

"The market" has no idea what it wants or doesn't want. First it wants something, but then when it gets it, it decides that it doesn't want it anymore (TARP, stimulus, foreclosure mitigation, etc.). And when the government doesnt' do anything, it complains that there is too much uncertainty. It's just absurd.

According to my sources, it should come at any moment. Judge Whyte has stated that he wants to send his Hynix judgement to the CAFC (U.S. Court of Appeals - DC Circuit), so that the appeals court can compare his findings versus the adverse ruling that was handed down by Judge Robinson from Delaware. Since Judge Robinson wrote the finalizations of her case already, Judge Whyte needs to do it within 30 days of hers (the length of time Rambus can appeal Delaware). Keep in mind, Judge Whyte asked Rambus which was more important to them; the finalization of Hynix or continuing the DDR2 case as he doesn't have the resources to do both in a timely manner. What intrigues me is he told Rambus and Hynix to meet before he finalizes his ruling. I'm not sure why? It's possible that Rambus and Hynix knows to an extent the damages and remedy he is awarding Rambus, and given Hynix's financial concern, is giving them a chance to settle on some terms beforehand? Who knows what they're doing, but that was one of the possibilities thrown out there.

There's 2 other important dates...

One is this upcoming Monday, where the Supreme Court will decide if they will hear the FTC's case against Rambus, deny to hear it at all or ask the surgeon general for his advice. This is the FTC's last chance, as the appeals court ruled unanimously not to hear it. We should know sometihng by 10am Monday on this.

Second, since DDR2 is on hold until at least May 2009 (when Judge Whyte will ask for status), or later than that once the CADC rules, the most important trial is the antitrust. Judge Kramer is slated to start in April. There's a few case management conferences at the end of this month that should confirm this. The hope hear is that it is not delayed. No delay means pressure on all sides to settle before the DDR2 starts. There's a lot of damaging documents in this.

Not sure if this hit the newswire yet, but my sources called me to let me know that the Supreme Court will deny FTC's request to examine Rambus's alleged antitrust and monopoly violations.

If the stock has not done anything yet, it will, time to buy.

This market is holding back Rambus with it's freaking free fall. Opportunity to buy knowing that the FTC and it's Section 2 enforcement is behind us. This opens the door for licensing as a lot of companies were hesitant to sign up with the imposed FTC order.

I ran out of dry powder for the time being. It's not like I don't own enough RMBS shares anyway. In a normal market, this news would have been good for a $4-$5 dollar gain.

Guys... BUY in the after hours. Judge Whyte just handed down Hynix's sentence.

1) Hynix needs to pay Rambus on not only SDRAM and DDR, but DDR2 and DDR3 since they stipulated this before the trial! This means the DDR2 trial that was postponed is relatively moot, for the purposes of Rambus vs Hynix.

2) Hynix needs to pay 4.25% for all past damages.

3) This includes payment from their Oregon fab Hynix seeked to exclude since it sold DRAM overseas.

4) Hynix needs to pay 4.25 for all damages 2005 to present.

5) Hynix and Rambus has a short deadline to set royalty rates in the future or else the Judge will set one.

6) Hynix needs to pay interest on back penalties not paid.

Bottomline: This is worth about $450+ million!
