My friend was trying to get into Med school, so it was pretty important that he have a clean record. However, since a cop had observed direct evidence that my friend had committed the crime, he went ahead and pressed charges. They even went to court. My friend's lawyer went over to the prosecuting attorney's, explained the situation to them, and got a deal while they were laughing their butts off. He ended up getting off with a fine or a little community service, can't recall.
But my point is, that if the coppers saw you do it or otherwise have direct evidence against you, then they may press charges themselves. I'm not sure how it all works tho.
