I had a similar situation last year but we're both renters. I used an air purifier when it got bad, but my neighbor died and some non-smokers moved in.

Could you have the next door owner install smoke detectors? I'm sure they must be concerned that 3 smokers smelling up their house is going to hurt the value. Smoke-proofing the walls while you contact them would be good too. I don't think you'll get far with the tenants.

It couldn't hurt to contact the owner. If he won't do anything about it, be as polite as possible and let them know about your issues. If they don't give a fuck, they don't, but you're still in the same place they started. Who knows, they may be really nice people who would appreciate their neighbor letting them know rather than silently stewing about it.

You are in Florida. There is no law in Florida. I would find out why the smell is entering your home and fix it. There is not much you can do in complaining in FL.

Fix the air transfer, fix the problem.
1: electrical outlets. often they are a source for draftiness and air transfer.
2: baseboards, or lack thereof in closets.
3: insufficient makeup air source. This is the big one. If your side is tight, your bathroom and kitechen fan will pull the smoke over. In fact, it is really the only way it will get into your space, if you are providing a lower pressure in your space. try cracking a window and blocking it for security.
I bet your odor problem goes away.

Chances are they aren't gonna want to hear your side. Generally smokers think its them against the world which is compounded by the fact that they are generally low class.

I'd start by getting better furnace filters. Also try to seal the attic space and any other air pathways. If that doesn't do it, talk to the landlord. If that doesn't do it, talk to the neighbors. If that doesn't work consult an attorney. I agree they are lowering your quality of life and decreasing (DRAMATICALLY) the value of your half of the duplex. If I were a buyer and walked into a place that smelled like smoke I wouldn't buy. PERIOD.

I think if you try everything else first, you will have more pull w/ a judge if it has to go a legal route.

Good luck.

Yeah, he should have to deal with the expense of moving because his neighbors are damaging his property.

OP, is the owner of the unit they're renting aware that they smoke inside? If not, he might not be happy about it.
ahahhaha, i love it when people respond to my trolls :D

It's also cool to hate an idiot that has nothing helpful to say.

Cut the crap! He is right. You are losing ma man!

Wow struck up a nerve with the "I'm a victim" crowd. You're responsible for your own comfort as long as it's legal. In the case of the OP he has several choices which, if you would have bothered to read, I offered in previous posts. Correct the structural problems and get know them then talk to them about.

Unfortunately there seems to be the "I'm not responsible, I'm a victim" crowd that just wants to post things like "Smokers are the new Nazis. It is cool to hate them." and "Smokers have no empathy for non-smokers. In fact, most smokers are low class and ignorant."

If the choices in the world is to associate with people like you or the "low class and ignorant" I'll choose the low class at least they don't have that false air of smugness about them which stinks worse than cigarette smoke..
Smoking causes cancer, ruins cardiovascular health, and ruins materials with tar and scent.
Second hand smoke (especially at the hands of a neighbor or parent, day in and day out) will negatively affect ones health and quality of life.
That is the same as assault and battery.

Think about someone else for a change.

Sorry, I see you're not quite fast enough on the uptake to realize that my last two posts were more of a comment on your less than helpful, all I can offer is derogatory comments, when reply to the OP. The OP didn't ask to debate whether cigarette smoke was harmful, we all know it is, but if he should talk to his neighbors about the smoke seeping into his home. Helpful suggestions were offered by quite a few people, your not one of them.

Your response was call all smokers low class ignorant Nazis and it's okay to hate them with out offering any helpful comments. That sir, makes you an a$$, especially in light of your statement, " Think about someone else for a change" which apparently you do not do.

Oh by the way, it's not even close to being the same as "assault & battery" I guess you need to watch more Law & Order and CSI to enhance your legal education.
I need to have the last word.

It's yours.

I don't think there is much you or they can do, short of them not smoking. Do you rent or own your half of the duplex? If you rent, is it the same landlord? If its, bring it up to the landlord. It will ultimately be his/her responsibility to keep their environment from seeping into yours.

Whoa, all this ruckus  I was just asking whether it's uncouth or not to bring this up  Looks like I will try sealing outlets, or any possible way the smell could be leaking over. I just checked, the attic space is shared, should sealing off the walls not work, I will look into dividing the space. Thanks Amused

Damn, they smoke so much the smell travels with you all the way to work? Or do you seriously have an "office" inside your half of the duplex?

What kind of mother lets her two sons smoke in her house? Sounds like a real enabler how old are these 'boys'?

I predict BIG problems in the future with them save your effort and GTFO.

If you don't then Don't come crying here when you get burglarized, or they keep you up at night, or cops are always over there, or they find a math lab, etc.

I know, right? Sheesh... people are a bunch of over emotional bitches these days.

Anyhow, if dividing the attic is too expensive, an attic fan that runs all the time might do the trick too by creating negative pressure up there.

And yep, foam in all the outlets and switches might work too.

they make these foam gaskets for wall plates, they are quick and easy. Do try out the window trick and see if that reduces the problem. Just pick a window upwind from them, LOL!

I have the same problem right now :( it really sucks.

in my apartment, people 2 doors down smoke so so much so it actually fills the whole hallway with cigarette smoke. there's like 8 people living in there, smoking like crazy.

that seeps into my apartment. also the people below me smoke and blow it into the range hood, so that fills my apt with smoke as well.

not much i can do about it :( smoking is permitted in the bldg
