Hey, what's the distance between the toll booths and where the lanes merge? It seems like there's not much distance to do what you did. I probably would've done it if the lanes didn't merge but as is, it seems risky. I know you are adamant about it not being your fault, but I'm sorry, it looks like you brought about the accident. You could have easily stayed behind the truck and merged in with him.

I wouldn't take it to court, you would lose-- the officer's report doesn't help either. Just have it repaired.. your choice to make a claim or pay for it out of pocket.. and learn from your mistake (no showboating, even if you do have a fast car!)

I don't know what the rules are on changing lanes after a toll booth, but as far as the trooper saying that if the f250 hit you there would be more damage, that makes no sense.

potential damage would come from an equation involving vehicle mass and velocity, so even a heavy vehicle could do small damage if the velocity is low.


based on your diagram it looks like the truck didn't see you and was changing lanes. the only issue i can see is if when you changed lanes it was legal or not, but even that wouldn't have caused the accident if the truck didn't attempt to change lanes too.

seems to me the officer's opinion flows from an erroneous assumption about physics.

For the most part, unless you've got crappy pavement it won't be an issue, as you've got to near totally unload the suspension. Up here in Socialist Canada, where roads pave you, it's more of a concern, but anywhere with decent road crews shouldn't have potholes or cracks big enough to slam a Bimmer that bad.

i did zoomed up in front of him but in my own lane and he was still in the sunpass lane

You'd think an automatic tolling booth would have a camera, otherwise how are they gonna bill you? ;)

Yeah, check it out and see if they'll let you review the relevant footage, but sadly it's sounding more and more like you were in a rush to get by the truck and made a haul-ass pass on his right.

if U want to go to court, draw a good diagram and take it with U to court and explain it to the judge.

But according to the tropper, U R at fault but the tropper wasn't there at the time this happen so U still can fight.

One advice, next time keep your eye open. Try to avoid all accident if possible.

Saw an M5 at Starbucks this morning. Admired the car for a minute in the parking lot, go in, and sure enough, there's someone screaming at the Starbucks girl. yes take it to court dude! i was in an accident that was somewhat similiar, in the sense that the cop wasnt there. however, I received the ticket because i was the younger driver, and from what he THOUGHT happened. however, when I went to court, the first thing the judge was said "can any witnesses please stand up?" ... he waited about 10 seconds, no one stood up and he said "this case is dismissed, next!".

also, the other driver of the other car was not present, due to i guess them knowing it was their fault. so if the cop isn't a witness, the cop can't say sh!t.

Your diagram isn't clear, that's why people are getting confused. Draw several ones to show the incident as it progresses. Also drawe the lanes (which one merges to which) precisely.

Gotcha, I have to take my car for it's scheduled maintainence next week anyway so I will ask them to check for this. I've hit a couple nasty bumps over the years so if anything should have happened it would have already. Again, thanks for the tip.

NJ/NY roads are probably just as bad as it is up by you. Hey, I never said I WASN'T an asshole but lemme have my fun and kill time at work mmkay :D

The Sunpass lane doesnt merge with anything it has its OWN lane all the way to the Turnpike
The lane i was in after i moved over from the Sunpass lane merges into one lane that itself has its OWN lane all the way to the turnpike and he was still in the Sunpass lane untill he tried to move over in2 mine

i will try to do a more detail drawing when i get home from work.

sounds to me (knowing sunpass), you couldn't make up your mind to pass or get behind....

what happens to me is I go through slowing a bit from 45/55 because it says 25 on it or whatever (I am going faster than that) some moron in a honda or whatever tries to fly up behind me and then gets on my right which merges, and then never passes......I know my lane is about to merge with his and he is just sitting there...if I speed up so does he, if I slow he slows constantly in my blindspot or on my front 3/4's.

In the end I just drop it....hell if I am being forced in to the next lane over when *their* lane says MERGE!

what is the REAL story?

As someone said, since the PO said it was your fault, it will be extremely difficult to prove otherwise.
Unless Sunpass have a tape or you have an independent witness, you are not going to win, your word vs his.

Update1: my car will be fix by Saturday, cant wait im tired of driving a Gallant.
i finally had a chance to drive by the same toll plaza again and notice that there isnt any solid lines after the tolls BUT i thought the sunpass lane goes straight onto the turnpike without having to merge with any other lanes but actually it does have to merge to the right lane and next to that lane is the lane i was in after passing him. so he had to cross to lane to hit me??

i also talked to a lawyer and not one of those ticket lawyers and he said my insurance company will try to sort this out with their liability department and the other guys insurance and that its not worth it to take 2 court since i wasnt injured

we werent going tat fast cause it was an entrance ramp
and i KNOW that i was gonna pass him
the Sunpass lane merges with the right lane but there is another lane next to that one that i was in!!
