So your friend got caught stealing and somehow she is angry about having to go through crap after she got caught?

Bally's had no right to do that, they should have just called the cops, but still her fault for breaking the law.

Even if your friend borrowed from another friend, that makes them both culpable.

Breaking the law?

Yes, stealing is breaking the law, last I checked.

ANd even then i had to spent hours on the phone with them to get my money back for 3 months they charged me for.

I can't say it enough. DO NOT STEP INSIDE A BALLY'S IF YOU ARE LOOKING FOR A GYM. YOU WILL BE SORRY!

I agree ballys is a pretty crappy gym, but I pay $108/yr for my membership and that price just cannot be beat.

Stealing is against the law that's for sure. But I cant help but think entrapment or something like it. You cant force someone to sign into a contract that makes it not legally binding. Even giving an ultimatum such as sign this or face legal action. The contract for 3 years that she signed isnt legally binding. I could be wrong.

How did she sign up for a three year membership and cancel the card and membership? Sounds like she just cancelled the card and now they can take her to collections for the membership she signed up for.

Can she get tracked down and get charged after she stepped out of Bally's since she canceled her membership at ballys?

Yah thats why I suck it up and just go. It comes down to like $9/mo ... no way in hell I can complain with that price. The only thing I don't like about the bally's near me is the crowd and how alot of the time people don't put weights back. other than that its just fine.

So she was caught using someone else's membership? Meaning as in a membership that isn't hers. And so she's upset that they made her sign up for her own membership, those sheisty businesses.

Well probably, like most gym's have a period of say, 30-days, that somoene can "change their mind" and cancel the contract and be no worse for wear. She probably called the 800# (or whatever), cancelled the contract, and cancelled her card for good measure.

She should have not been stealing in the first place.

But since she didn't do that...

She should have just left, and paid her friend if they cancelled her friends membership.

But since she didn't do that...

She should have just kept the membership for a while and gone through the trouble of cancelling it through Bally's.

The most they can legally do is terminate the membership of the rightful card holder. I believ ethat's all that's in the contract.

What exactly did she steal? They can't coherse her into signing a legally binding contract. That's called *gasp* cohersion.

Actually, its called "coercion"

I would say that she stole use of the company's equipment and/or services.

The use was paid for, just not used by the same person who paid for it. Would you say the same thing about someone who uses your computer? You bought windows but someone else is using your license. Who cares, it was paid for.
