1st offense should be 1 year in jail-5 years loss of license, unless they cause a fatal accident...then life in prison.
2nd offense should be 5 years in prison-lifetime loss of license, unless they cause a fatal accident...then life in prison.
3rd offense should be 20 years in prison...unless they cause a fatal accident...then life in prison.

laws have to be based on actions not outcomes. but i agree we need to toughen them up.

I know someone who life was basically ruined for a DUI. She lost her job, had to spend a weekend in jail. She had to do around 100 hours of street clean up. Lost her license for a year. Really her life was ruined for some time because of small error. She is a strong person and has managed to pull through thouh. The law is too strict if anything, no one should go through what she did for a small mistake.

can someone explain what the difference between DUI and DWI is?

also, can't you still be pwned by the police even if your BAC is below the legal limit?

Considering that the legal limit is fairly low, if your BAC is below 0.08 and you're acting drunk enough to get pulled over, there is something wrong with you.

its really dependent on the person, ive seen people so drunk they cant walk and they have a BAC of less then .1

and then ive seen people up around .25 who look/act 100% stone sober

I'd ounce, but I'm on a 'high' right now.

Her life wouldn't have been "ruined" had she not been driving while intoxicated.

Her life wasn't ruined, or even close.

did the driver tell you he only had "a couple of beers" ? seems like the standard response.

"Half a beer." He said we're going to have a conversation when the blood results come back and show that he wasn't intoxicated. (heh)

Another guy on that night was a Standardized Field Sobriety Test instructor and watched me test him..said he was definitely impaired (failed all three tests). We'll see. :p

Did you miss the part where all FSTs were failed and we don't even have BAC results yet?

 THANKS!!

I've seen too many accidents, some fatal, some not, caused by stupid people who thought drinking didn't affect their driving capabilities...however, my position on drunk drivers merely scratches the surface of my "wackosity." but, that's another thread entirely...:D

I agree with your opinion on the severity of punishment ...but on the other hand...taking away someones ability to get to a work place etc really isnt going to do a lot of good for reducing crime

Should have given the perp a good beating and then threw his keys into a very large open field and left him to find them... I hate drunk drivers.

Yep, because driving drunk is a constitutional right...right?

THIS country basically gives someone a slap on the wrist for drunk driving...here's a list of what happens in other parts of the world:

He's probably referring to your suggestion of life in prison.

Texas has already handed out life sentences for drunk drivers. The last one I heard about was a guy that got arrested and there was no accident or injuries involved.

I firmly believe that the punishment should be more severe. DUI's are supposed to be serious, but they end up just being a tax. I would have learned much faster if my first one caused me anything more than some financial hardship..or my second...or my third....

Pretty sure most of that list is bs.

I think any penalty not correlated to the BAC level is extreme. Someone that blows a 0.06 in a 0.05 limit state is a lot different than someone cruising around with a 0.12 or something. I can't even imagine how many countless otherwise productive lives would be destroyed if such a law were in place. Granted, many lives are destroyed by drunk drivers as well, so I don't have the answers obviously.

As far as the fatal accident is concerned though, I agree.

The point is that the average person can't tell the difference between .05 and .12. The only law that makes sense is a zero tolerance law. If you have been drinking at all, you shouldn't drive. Maybe an exception if your BAC is below .02. That would be around a drink or 2 tops.

Its not terribly difficult to make an educated guess, if you think you're close or if you're unsure don't drive. We need to bring back personal responsibility.

How could someone make an educated guess? The only time most people find out what their BAC is, its much too late to decide.

I too believe that we should bring back personal responsibility. The problem right now is that the government is saying that a certain BAC is legal, but the majority of the population has no idea how to find out what their BAC is.
