No one is advocating leaving anything up to the states exclusively. Or at least I am not.

My opinion is that if this legislation is an example of politicians running rough-shod over the will of their constituents, that there are tools built in to override them, and that they should not fear to use them.

Also, equating slavery to health care is hardly fair. The lack of health care does not so grossly abridge one's liberty. Slavery is to liberty what murder is to life. Health care, in the end, is secondary.

Well then all these little whiners need to call there state legislators and tell them to pass laws against it. I don't think they will get to first base in most places because I personally don't think they are going against the will of the people. I think the vast majority of the people want health care reform.

I'm not equating health care to slavery. There may be some comparisons that could be made but that wasn't my point. My point is there are cases where the country's right to pass moral legislation outweighs the states right to do whatever it wants. Salvery is just one of those examples as is discrimination and IMO, health care is also one of those cases.

So you have no problem with stripping health insurance companies of their exemption from federal antitrust laws.

And just to be clear, an individual state is under no obligation to establish insurance exchanges, however, if they refuse to do so the Fed will establish an exchange in that state.

Yah see, there's this thing called the Commerce Clause. Are you representing that health coverage stops at state lines?

Why should people from one state have different (better?) health care then people in another state? That is not the way a country works, at least not one that plans on exisiting for long. Everybody needs to be able to afford healthcare just as they need to be able to afford food.

Even if the suit is successful, only the mandate will be truck down, not the entire reform. And the mandate can be reworded as a tax increase for all with a rebate for those who buy insurance. It's not like the federal government is really breaking new ground here.

As long as they work to control the costs while providing the best healthcare possible, what's wrong with that?

The bill is going to be law. Instead of arguing about it like a bunch of little kids we should be disscussing the nut's and bolts of how to cut costs. Otherwise this could turn into nothing but another rip-off of the taxpayer, like the S&L bailout or the money we gave to the banks for investing in crap they knew better to invest in.

In addition to the Commerce Clause there is an economic argument that goes like this:

Uninsured/Underinsured persons represent a significant cost to the overall delivery of care - compelling them to maintain a minimum standard of coverage reduces the financial burden they formally placed on the system.

This is an extreme example: The Octo-Mom.

I imagine the Fed and the State of Cal took a pretty big hit on that one.
