How interesting. Under those guidelines, that guy committed battery. She would have to show a well founded fear of imminent peril, I suppose, for her self-defense claims to be taken seriously.. Altho her response seems a somewhat disproportionate to the threat.

Way over reacting? Yes

Proper way to react to a "Hate Crime"? Not in my opinion. Spitting on someone and tossing a cigarette is WRONG, but it is NOT life threatening so to stab and beat someone for that is just plain assault. If there was a hate crime committed, it was committed by the women IMO.

That's not the issue i raise. The issue in most countries is that force used in 'self-defence' has to be proportional to the degree of threat and what is necessary to remove that threat. In this case, they went FAR above & beyond a proportional response, which might have been spitting back, or slapping/punching him at the most.

What they should have done is reported it to a cop..with 6 witnesses at least they'd be laughing...

As to your question, if the guy knew it, it would most likely be i suppose...

EDIT: and really, they got lucky they didn't have gun, since the shooter would be up for murder...

Sounds like a reasonable response to me. The guy was becoming very abusive, in the heat of the moment all kinds of past events would have probably scared the chick senseless.
