Littering - disagreement with a Chief magistrate judge

There was a lot of that casual public littering in my town in the late '80s and early '90s, but there has been a sharp decline since then.

It enrages me to see the same behavior that used to be commonplace around here.

I live near the ghetto, with a lot of homeless and drug addicts nearby and they do not give any fucks and litter all over the place. Pisses me off.

Also, what is with smokers thinking it's ok to throw their disgusting cigarette butts everywhere?

Yeah. It's their disgusting habit so dealing with the trash properly is their problem. It's not the disgusting habit that bothers me either: it's the "well what do you expect me to do with it?" behavior. THAT'S YOUR PROBLEM THAT YOU ACCEPTED AND AGREED TO DEAL WITH WHEN YOU TOOK ON THE ACTIVITY, GENIUS!

I send the county a bill for fertilization services when I do that. They must be routing it wrong(fuckin' government!), cause I haven't recieved payment yet :^S

I'm ok with minor organic trash. Unfortunately people don't distinguish between a banana and bottle.

I wonder if the fact that we haven't had an anti-littering campaign in a couple generations has anything to do with this. I know it was drilled into me from tv and other ads. I think we need to do some mass re-education.
They should bring the whip back. A lash for every pound of trash (3 lash minimum).
Or the pillory. Then people can throw their trash at the offenders.

I don't litter cause it's intuitively logical that you don't shit in your bed. I'm not sure education would do much. They're fundamentally flawed humans.

I dont think 27 tickets for 27 bags is "fair", but I certainly dont think 1 ticket for 27 bags is any better. Maybe create a system based on weight or biodegradibility with a fairly high cap on the max ticket amount. Because the guy that dumps 5 gallons of old paint and oil on the side of the road should not have the same ticket as the guy who threw his coke can out the window.

No, we get that sometimes. Apple core, bananna peels, tobacco leaves blowing off a trailer you won't get a ticket from me. But if you're pulling a trailer of tree limbs and you didn't make a reasonable effort to secure your load and a tree limb falls off onto the hwy, yes I will write you a ticket.

....What exactly is your role/job?

Obviously it sounds like you have authority to pull someone over and/or ticket them - but at the same time you don't sound like a police officer. What is your job that you are able to have authority to pull people over and such?

Anyhow, keep doing what you're doing man. I sincerely hope we get more like you in our area and other cesspools of 'Merica. If it were up to me your minimum ticket would be $300 and you can write as many as you want for each instance... Much like when someone goes in and commits a crime (shoots up a place, robs a store, etc...), they will be charged for each and every law they have broken.

Gonna go out on a limb and guess what's going on...

OP has authority to issue littering citations (although we still don't know his job) and does so based on camera evidence and license plate numbers captured.

I'm betting that since these are just tickets issued through the mail, the degree of the offense can't be argued either way and the magistrate has no ability to do anything other than issue a standard fine. A cigarette butt or 27 bags of trash, same fine.

A license plate is as much an individual as an IP address is.

Fight it. They'll subpoena mobile phone location data. Check your alibis. All that...

If you're caught lying, penalties will be even more harsh.

...or that's the way it needs to work.

I'm a law enforcement officer that enforces only the animal control and littering laws of this county. We will put officers with tripod mounted hd cameras in the woods near heavily littered roads and highways. Once a violation is observed he notifies the uniformed officers that stops the vehicle and issues the citation. Often open container, child restraint, driving under suspension and drug possession violations are also discovered. The video evidence is cut from the days video and presented in court on a surface pro.

I agree with Olds. Littering pisses me off to no end. Here is my quick story.

My son is a Cub Scout. One of his electives was to clean up our road. So we set off with a couple of those grabby trash picker things. We ended up filling 12 bags up in a few hours which we picked up when we were done.

What we realized was the bulk of the litter was near a secluded area with no houses in sight. We felt good about our good deed but just a few days later, that same damn secluded stretch of road was already a minefield of trash again. Beer cans, cig butts, diapers, you name it!

My son was disappointed and I had to explain to him in the most age-appropriate way I could that some people are just scum.

I would love a job like what you have, OP. I'd set up cameras on that stretch of road, right where these idiots think its "safe" to litter and not get caught. I'd bust people all day and love it.

I think you need to look for more laws. Perhaps improper disposal of hazardous waste for the tires?

It is very frustrating to watch people clean theirs while driving down a road and only write one citation. I was wrong on the fine amount earlier, we usually get $464 and 8 hours litter pickup or an additional $40 in lieu of the 8 hours. Unfortunately it seems to not have helped the littering problem at all. Most of these people live in the same neighborhood that they litter in. I just do not understand the mentality behind the justifying of throwing a can out the window or dumping a couch , love seat and three bags of garbage in a ditch on a secluded road (my latest case). Anyways, thanks everyone for the feedback. Mr. Carson, dog catching is also part of my duties and it too has its really good moments. Thanks again to everyone...
