I see your point, but it doesn't apply as the law looks at intramarital rape different than extramarital rape. Not saying that rape between married couples doesn't exist (it does), just that it's quite a bit harder to make the charge stick. The fact that the couple got married in first place does imply some degree of consent.
On the other hand, it is much easier to make rape cases stick between two passing strangers, as we see here in the Kobe case. And yes, there have been rape convictions where the alleged victim didn't come forth until years after the fact (although the statute of limitations varies from state to state).

LOL. That'd be great in a divorce case. My husband raped me, I became pregnant with our current 15 year old kid! I just changed my mind, I didn't really want sex!

laugh all you want but it does happen. The last one that was in the news was 2 kids around 16 were having sex. she said stop and pull out. he took less then 15 seconds to respond. he was charged and convicted of rape.


there have been other stories of women the NEXT day saying they didnt want to have sex and declared rape. EVEN though like in the kobe case she NEVER said no.

Don't get me wrong. I'd have no problem convicting Kobe if I thought he did it based on the evidence. I don't like basketball and I don't like the lakers or Kobe. And he clearly lacks character. But based on this evidence that the prosecution has introduced, I don't see how she has a case. First of all, having 3 loads in here makes her look like a major skank which just plain damages her credibility. Slutty girls can certainly get raped...but do they go and have a little comfort fvck an hour after it happens? I hope not.

Kobe: Rapist? No from what I've seen. Man-whore womanizing cheater? Sure. And thats not a crime. Although California may pass a law against it sometime soon. ;)

i'm still unclear. it seems that the girl (or guy, but that's purely hypothetical) can say no at any point during sex, and if the other person doesn't stop that means it's rape. ok, i can understand that. but if two people are having consensual sex the entire time, then the next day (or hell, 10 seconds after it's done) one person decides they didn't want it, that's still rape? nuh uh. no way. none of the links posted suggested that, and on no level is it possible for anyone to say the sex wasn't consensual when during the entire episode no protests were made in any way. what's the opposing party supposed to do, read minds? sorry, it's bullshijt for anyone to say that's the law anywhere unless they post a clear example of a case.

I agree, and the point of the defense bringing that evidence to light is, having sex shortly after supposedly being raped is NOT behavior consistent with a rape victim.

The way I read the MSNBC article, it sounds as though the notion that she had sex after the alleged rape is just a defense contention. As the article puts it, the presence of other DNA just might be indicative of sex in the time period surrounding the alleged rape, not necessarily after.

Here's what I think:

- Kobe may or may not be guilty. I tend to think there is sufficient reasonable doubt, based on the victim's own erratic behavior, to acquit him. This does NOT necessarily mean he isn't guilty.

- Kobe is NOT, at this point, a rapist as far as I'm concerned. He is to be presumed innocent until proven guilty, and I tend to think he will be acquitted.

- This girl's behavior looks bad, but it is mean and destructive to society to be publically calling her a "slut," a "cum dumpster," or other crass names. Her prior sexual behavior is not relevant to what actually happened with Kobe (though it might well be relevant in his trial, once the door of that room closed, it ceased to have anything to do with his behavior). Making fun of women who accuse others of rape makes it harder for other sexual assault victims to come forward. If this woman were your mother or sister, and you knew she had really been raped, notwithstanding prior promiscuity, how would it make you feel to hear others call her a "cum dumpster"? I find it sad and disappointing that she has been publically villified the way she has, primarily because her alleged rapist is a famous athlete.

- Ultimately, Kobe is either lucky, in that he raped a crazy, promiscuous 19-year-old woman, or unlucky, in that he had consensual sex with a crazy, promiscuous 19-year-old woman. Either way, he screwed up, and let's not pretend he is some kind of saint.

saint? hell no. he broke his vows to be faithfull to his wife. Thats enough for me to dislike the man.

i do not believe he raped this girl.

On a side note i wish conviction of rape was a harsher offense. But on the same side false allacations should be just as harsh. Changing your mind after the fact is NOT grounds for a rape conviction.
