Definately,

Kobe should go to jail for 20 years for a$$-raping that girl. But if wants to have any money left - buy a big house in Texas or Florida then file.

I have no reason to take sides with Kobe and, sadly, all I know about this case has come directly from the media like all of you have learned about it. However, I can't believe this is still going on. That "cum bucket" of a girl needs to get her priorities straight. If she did have sex after being "raped" - she's a freak. Sad, very sad.

This happened to me once. It was a very scary time even though I knew I had done nothing wrong.

Anyway, the story in that article doesn't read quite the same as what I was hearing on the news last night. Apparently the defense just SAID they had DNA evidence and the prosecution wasn't ready to hear something like that so they decided to retest their own to be sure, although I'm sure that was just to buy some time to investigate the defense claims.

I heard some interesting 'what-if' scenarios last night also. What if the defense just said something like that and doesn't really have anything, but has just enough so as not to be disbarred? It really impacted public opinion (obviously as seen in this thread) and there's no way its not going to filter to potential jurors.

First, Kobe could not possibly file for BK right now. He is simply too rich.

Second, to all you idiot Laker fanbois, there haven't been any lawsuits (much less anymore...), this is a criminal trial! Get a fsckin' clue. That "cum bucket" :disgust: is not going to make a single thin dime off this.
It is true that she could sue later, but she hasn't sued yet, and it sure seems like she's going through a lot of hell for someone who isn't yet digging for any money.

Anyway, Don_Vito made an excellent post. While I would always favor the presumption that the accused is innocent until proven guilty, I find it appalling that a rich NBA star will be acquitted where a common man would surely be convicted. There is no justice there, merely corruption.

Interesting point. I haven't really been following this case so I did largely make my rudimentary judgement on it based on that article. If thats the case, the defense is playing with fire.

If you don't mind...could you elaborate on your story involving a false accusation. I'm just curious.

I was reading my g/f's cosmo a few months back (shut up, like you don't ever read those things) and there was an article about false rape accusations and how a lot of women pull them now. This one newscaster had a woman who was obsessed with him that he'd never met or seen or talked with accuse him of rape. It ended up costing him 10K in legal fees to win the case. And they don't even have to win the case to hurt you bad, your name gets dragged through the mud. The rape trials on the front page. The 'found innocent' ends up on page 5 six weeks later, and many people are still going to think you did it and got away with it. Its scary.

And as I said, the worst part is it forces us to doubt women who have actually been raped. It makes it easier for people who actually did it to get away with it.

Well, the whole idea of the false accusation is to taint the jury pool and to influence public opinion. People believe everything they read without requiring proof (see thread) so it's a gamble worth taking so long as you can be sure that taking the gamble won't back fire (disbarrment).

Example.

We have DNA evidence that suggests this girl had sex after she had sex with Kobe.

They might have DNA evidence that shows she had sex with someone else. But, it might not necessarily have been with someone after Kobe. But, if they say the evidence 'suggests' such a thing then it won't be a big deal if it is retested and found out that it was before. The damage is already done because people tend to hear the first part of the story and not the last. They'll remember that the girl had sex with someone after Kobe and forget that it was found out to actually be before.

*EDIT* Something like this actually happened in a major case recently. I can't remember the specifics but I believe the case was the Van Damme (sp?) case.

First off, I don't think he is guilty. Nor do I think that a common man would be convicted here; a common man wouldn't be accused in this exact situation because of the very fact that he isn't rich.
Don't think that this girl doesn't have a civil suit ready to go already. Obviously, she's been advised not to sue yet by her lawyers (and anyone else that advises her with any sense) because it would look like gold-digging at this point.
The defense has been asserting from day one that there was evidence that she had sex after Kobe....now we're finally finding out that this is likely true.
Being rich surely gets Kobe a great legal team, but even a public defender could make this case if the DA's evidence truly shows what the defense says it does.
I question whether the local DA would even have pressed charges had the accused been a "common man" instead of Kobe, especially given the credibility of their accuser. It's a classic "he said, she said" and the burden of proof is on her. If she had sex after Kobe, that is NOT behavior consistent with being a rape victim. I wouldn't convict anyone she acccused, and I don't think Kobe will be convicted, either.

Anyway, I have no doubt that she's after money.

i've never heard of anyone convicted of raping* a prositite. not saying it's never happened, just never heard of it.

*rape alone, with no beating or murder

As the UCLA story shows, the accuser has to be believable. If not, the guy is going to walk. In that case, the jury was swayed by the girl finishing a term paper before reporting the rape. Imagine what a jury is going to think when the accuser does another guy in the meantime and lies to cops about it when she finally comes forward.

Let time do it's thing and justice do it's thing, the only difference between "good going dude" and "you fvcking whore" is the gender, the actions can be the same.

I wouldn't call a woman a slut and i wouldn't call someone having sex without getting paid a whore, respect for the female gender is something i was raised with, obviously this has gone down the drain along with all other respect for all other things for some of you.

Is Kobe a rapist? I have no idea, neither do any of you, let the court review the case and see where it ends.

If money is all that gets Kobe out of this, than this is no different than all the rich people before him getting off on technicalities. In this regard, the law is constant. There should be no difference between a rich basketball player and a rich brat in the Hamptons.
