This it would seem is not correct. Illegal immigrants, for one thing, are not citizens of the USA. As such, it seems to me, they can't be convicted of crimes enacted and enforced by the USA. They can be deemed having entered the USA illegally, and dealt with officially in accordance with the laws of the USA. They are not in compliance with immigration policy, perhaps.
