"Neely, a former Michael Jackson impersonator, ranted about being hungry and thirsty and said that he wanted to return to jail and didn’t care if he lived or died",
He got what he wanted. Death by cop is the same thing.
He wanted to die and did exactly the thing that would end his life.
You are such butt hurt negro that lashes out at the white man any time you can.

Not caring if you live or die isn’t quite the same as killing yourself. There’s a big difference there.

The attacker was given the white glove treatment where as the Asian kid was stabbed, manhandled, thrown to the ground and automatically assumed as the attacker!

What happened to equality? Doesn't fucking exist but Squishy will always defend the black guy no matter what.

Progressive my ass.. all it is is RACISM plain for everyone to see!

Sorry. I am not sure what you think about the situation

But I kind of think that doesn’t carry a death sentence
I answered your question. Based on the evidence presented and Neely’s behavior, he at a minimum would’ve been charged with disturbing the peace. At maximum he would have been charged with menacing. I think he would’ve been charged with menacing. The crux is to what degree.

I at no point said anything about the result of the situation, nor my opinion of it.

My opinion is that excessive force was used during restraint and that the guy didn’t need to die, but the act of subduing him wasn’t the wrong choice.

Again just general discussion. Not direct at you but in general

But the lightest of the menacing charges is in the 3rd

Max of 3 months in jail

But I don’t think it meets the criteria for it..

3rd Degree Menacing: A person is guilty of 3rd degree menacing when he or she intentionally places or attempts to place another person in fear of death or imminent physical injury.

Ah I’ve been quite diplomatic about it. If the race dynamic was reversed I’d still be of the same opinion.

I’m sure a lawyer could argue for fear of imminent physical injury. The counter argument would place emphasis on intentionality. but if it’s not menacing, then what is it? Disturbing the piece seems too light. Multiple people said they were worried about being in danger.

Yeah same for me.. the thing that turned me off immediately was he was threatening others.

I'm just glad there were no more casualties except the instigator himself.

Sadly in America that's usually not the case and we have a shit ton of shootings.

I can state unequivocally you are NOT for equal rights. I want POC to have the same rights as and you don't.
What kind of projection nonsense is that? I have never stated anything that aligns with that.

It seems very much like you want to stereotype people who merely disagree with you, without even knowing what race they are.

POC do have the same rights as Penny. This was an outlier because first, he was a veteran and second because people are fed up with loons of any ethnicity (which includes white if that isn't obvious), taking it out on innocent civilians. You just don't intimidate people trapped in an enclosed area where they can't leave.

If you had paid attention to what I wrote, I stated that I think Penny is guilty of manslaughter. I don't want "heros" who use force without consequences, roaming around free in society. That's the thing about "heros", we applaud their sacrifice, putting themselves at risk, and this is one of those risks, that if they go too far, they should face the consequences.

Either way, this is a diversion from your tit for tat argument that society should start getting rabid and use excuses to attack each other, which could never turn out well.

You don't want the same rights. You want retribution against innocent people based on what someone else did, if they happened to be the same skin color, just like many other racists.

You are a racist, just trying to play the flip side and keep the hate alive like a true scumbag. This is not just a counter argument to your participation in this topic, you've displayed this racist rabid mentality for quite a while now.

Seek professional help, instead of being a coward that hopes someone else does your dirty deeds for you.

anybody can argue complete nonsense…

Just like the woman who called the cops on people bbq in a park.

To get to the serious charges of menacing he would need a weapon. Without one it would be a very hard to go past 3rd degree and I did not hear he had one

Certainly not by clergy.. At 57 this is what I believe.
I have zero issues with someone being black.
My son in law is black and a leo .My two grandchildren are biracial.
I just hate race baiting assholes.

How is it nonsense to argue that people weren’t worried about their safety? Dude was going off. Put yourself in a persons shoes who’s sitting or standing where this guy was screaming. You’d be uncomfortable.

Yes the people committing the assault need to be appropriately punished.

But this has fuck all to do with the case this thread is about.

Uncomfortable doesn’t mean it’s ok to grab a person and choke them to death though.

Come on man. There were women right near the guy, including a woman with a child. If an adult man is uncomfortable (I’m being very generous with this word), a woman is going to feel considerably worse.

The guy was behaving in a highly erratic manner and can easily be interpreted by someone as threatening. You don’t know if he’s a got a knife that he could spring out on someone, or if his mental state could lead to further escalation.

From my perspective it seems pretty reasonable that someone who is physically capable would interject to subdue the potential/real threat. Just in case.

I’ve already made my opinion clear in previous posts. The 6 minute hold and the subsequent fatality is the regrettable part of this.
