Did they screw up... someone did obviously, otherwise it wouldn't have been a media issue. Should the parents sue... no, but they will, that's American Way, the Promised Land that they dreamed of in their hovel in Mexico...


 
some of the responses in this thread confirm (at least in my eyes) that there is a severe lack of compassion among the younger generations these days.

Do people think the doctors are sitting back behind thier mohagany desks right now and just shrugging all of this off all the while thinking, "Bah, she's just an illegal immigrant...its no biggie..." ?? HELL NO.

Alot of time, effort, blood, sweat, and tears go into something like this. Her medical condition was life threatening, people including her family members AND DUKE staff wanted this girl to survive and live as normal a life as possible....people tried to make sure her surgery was a success, then it all came crashing down due to such a insignificant little error.

Everyone has a right to be angry, sad, and at the very least concerned, about the situation. NO one has the right to feel cheated out of thier money because the hospital and the DUKE school as well as whatever groups invloved decided this girl was in need of treatment.

If you feel cheated that the government is spending money recklessly trying to save people's lives (as in this instance) then I guess that says alot about the type of person you are. I for one don't see a better way for our government to spend money, regardless if the child was born here or not.

I can name off a dozen or so things that the government can stop spending money on, if they need to re-allocate funds for costs of this girl's health. That arguement just doesn't make sense....it is a life they were (are) trying to save. As for other people waiting for donor organs, I am sure that if this type of mistake happened to them, they would want the hospital to do whatever it can (including using other precious organs) to save thier life.... I am sure they (the people waiting for organs) have the compassion to understand what it is that girl is going through.

Because the experimental part has nothing to do with her brain damage. The HUGE goof up was the problem.

I think it's a sad state of affairs when this is one of the top news stories, when there are better things to worry about (and as for transplants and medical treatments, there are plenty of people in the same, if not, worse situation...).

But I suppose it's sad.
 
now can this family sue duke university for the mistake? or because shes not a citizen she cant?


i bet if they do sue, most hospitals will turn these types of cases away in fear of lawsuits.

While I am just guessing about that 65%, I would be willing to bet that most of the people having it done are older in age. I would say they are in their 60's.

Then one day comes when they say that the organs have come in and your son will be treated. They perform the operation and usy the wrong organs (blood type). Would you then say that, "Oh well, I'm a poor US citizen who couldn't afford to send my son to a fancy smancy uber hospital. They made an error, my son is near death...but they gave him a chance."

If you were to have the balls to say something like that, I'd have some serious reservations about you.

it has nothing to do whether she's an immigrant or not. the fact is she got a procedure she would not have been able to have and given hope. Her family should be greatful for that hope. These procedures are risky and the family should have weighed the risks. Suing in cases like this is what amounts to the large costs of hmo. Having surgery does not mean it will go perfect and what will suing for money get you? not your daughter back. This should fall under the good samaritan law.

Secondly, I have reservations about you because you are so quick to point blame when you are unable to help yourself, and out of the charity of someone else; you are willing to chastise those who are willing to help. You not only set a bad precedent for the future, but serve to show yourself as a greedy person who looks out for number 1, which in thus case you would not have received the procedure if the doctor and hospital was just like you.

For those that feel it's a money issue, get real. Go protest some other government waste. However, I'd like the point out that the government does not purchase $150 hammers and $500 toilet seats. This occurs because the GAO lists purchase orders by the whatever was requested most, not the entire list nor the number purchased. So infact, that hammer may be 10 or other items were purchased.

Immigrants will not cause the system to collapse. The fact that this is news worthy shows that.

You forget one thing. I'm not upset about the fact that Duke would or would not have been able to save the girls life with the transplant. That is beside the point.

The POINT is that they SCREWED up the initial transplant b/c only ONE doctor was there to verify the blood type of the organs and he OBVIOUSLY didn't do a good job of that. He FLEW up to get the organs and STILL couldn't get it right. Then when they got the organs back to Duke, the also failed to realize their mistakes.

THAT is my beef with Duke. NOT the fact that the operation wasn't guaranteed. The fact that they botched the selection process put her in more jeopardy than the "typical" operation ever would.
 
Before anyone jumps on my back for being ill willed or such, let me point out first of all it is a shame what has happened to this girl and I hold no ill will towards her.

I am so pissed off that a bunch of border jumpers can come over here and get all the surgeries they want and have it fall on us, the tax payers. I feel bad for these people, but does that mean we all have to make their lives better? No. Just like I don't agree with the funding of 3rd world countries and helping with their food/medical needs. I'm not saying that I, or we, as a country deserve more, or are better than other countries, but look at the amount of un-inscured LEGAL residents, and the number of homeless people we have starving. It's time this country started taking care of it's own, instead of everyone else's. Doesn't charity start at home? This may seem like a pretty extreme view on this but after you've worked at a job for almost 2 years, and had no health benefits, and 3 freakin time a university hospital tells you there's nothing wrong, and you know what it is, and you go to another doctor and they diagnose it the way you knew it, then had to go in for emergency surgery and stay in a hospital for 4 days and end up owing $30,000 and have lawyers on your ass, when then I guess I as a citizen have a right to be pissed off.

That is indeed sad. I was disappointed last night when they interviewed the mother. I understand being pissed off and bitter but she went beyond that. She accused the doctors of holding back and not giving her daughter the "medicine" to get better. Everyone knows that is not the case. I just hope the family realizes that everyone did the best they possibly could.
