So you think "O I haven't gotten into any accidents" means that it's safe? If your logic functions in that sense, it's flawed. If you crash, you could be dead. Or in jail if you kill someone. Many things are a distraction (obviously. If you think we're ignorant enough to not know even talking to a passenger is a distraction you're wrong), but some pose more danger than others. These laws are here to reduce distractions and chance of possible danger/death/injury.
One wheel on the tyre. Do that in a driving test in Australia and you'll fail. Just because they don't ban drinking coffee too doesn't mean it isn't dangerous. Use your common sense.
And as said by DrPizza, driving is a privilege. If you have no sense of responsibility when on the road, don't drive.
And as I've stated multiple times (to which nobody seems to have an answer for): There are already laws against doing dangerous things on the road that cell phone talking can lead to. Why do we need laws on top of laws? This is just as bad as the "open alcohol container" laws some states have. A half full bottle of rum sitting in the passenger seat isn't harming anybody, yet it's illegal to have because it "may" cause the driver to drink it.
The vast majority of people can drive while talking on phones and there ARE benefits to it. You guys also seem to have missed the fact that my whole argument for text messaging is very tongue-in-cheek. It's literally next to impossible to catch somebody text messaging while driving (even if it is illegal, which I'm sure it will be), yet it's probably MORE dangerous. Cell phone bans will only encourage people to text more which means less eyes on the road. Hold the phone underneath the windows and occasionally glance down to type our your message...impossible to enforce because the police can't see.
If people prove they can't drive while using cell phones (swerving, getting tickets, causing accidents, etc) then they will lose their license because of their bad driving. That's the perfect solution. Also, I haven't seen any studies showing that the rate of collisions have increased at the same rate as cell phone use.
