I spent a week in jail for finding a lost cellphone...legal recourse? [Thread Fail!]

I have a math problem here.

If I get paid on friday of each week. How many days is it between friday's? If i get paid every other week, how many days?

When does that equal 8 days?

Arrested saturday (morning)

Sat (am) -> Sun -> Mon -> Tue -> Wed -> Thu -> Fri -> Check Clears Sat AM -> Saturday post bail (first opportunity).
1 -> 2 -> 3 -> 4 -> 5 -> 6 -> 7 -> 8 days 7 nights.

You should have given it to the store. However, theres no mens rea for you to steal it. Get yourself a lawyer and sue. Putting you in jail for a week because of a simple misunderstanding is a clear violation of your civil rights. The cop was negligent.

The average law abiding citizen would've turned it into walmart right then and there so they could announce on their PA that the phone was found in the hopes the owner is still there or comes back to get it OR just left it there for someone else to worry about.

I would never had taken it out of the store. You did, and that means you more than likely intended to steal it.

I disagree. while i suspect (from reading his other threads) that he wanted to steal it.

I wouldnt have turned into walmart either. but i would have looked in the phone and seen if there was a number to call to return it.

i suspect there is more to the story then he is saying. he said he has not been in trouble. Yet couldn't get a signature bond? spent a week in jail?

So the OP went to the store to pick up some snacks, found a phone, person who lost phone remembered exactly where she lost phone, realized it wasn't there(and it did not occur to her upon not finding it that maybe she left it elsewhere), went to security, found someone in security, found a video over the exact spot where she lost phone, figured out exactly who it was who took the phone, went through surveillance to figure out that he left and where he went, grabbed two cops and found him in the parking lot?

That's the best 1AM surveillance crew ever assembled. EVER. And I'm not just talking about Wal-Mart.

Of course this time line is only believable if the OP and his GF are the slowest 1AM snack shoppers in the history of 1AM snack shoppers. (i.e. the OP was smoking at his car at 6AM outside of Wal-Mart)

I remember one thing that I would steal all the time were shits from school...mainly the nice graphing calculators and the Fluke multimeter's they had...real nice shit, was selling each at like $75 all day...I guess they never caught on or didnt care one because they never protected them or locked them up...they just kept buying more...hmmm...

Besides that Ive stolen a bunch of shit...dont really feel guilty for any of it as its always been shit from multi-billion dollar stores and shit like Walmart and what not.

I thought of that...but having worked retail most my life I know that just cause you turn something in to lost and found doesn't mean that some employee may not decide to pocket it or what have you. So I thought this a bad idea...turning it into Sprint seemed like the much more reasonable and intelligent thing to do.

Why would you care that much about some unknown person who is careless enough to leave a phone on a shelf in walmart? Surprisingly I have found walmart employees at the customer service desk to be honest. Its the ones in the back that steal.

Spending 8 days in jail for stealing a lost cell phone is stupid... but the police did make the right call.

And by a week in jail, I think it's safe to assume he was in there for a few hours or maybe overnight. No one is held for 8 days because they took a cell phone. Maybe he had outstanding warrants?

Nobody has advocated that. We are saying the story as it stands is HIGHLY unlikely based on both the situation and the fact that the OP is an admitted thief with no remorse.

Seriously, how long would he have to have sat in the store parking lot for the lady to have enough time to round up police to come arrest him? (Heck, even for her to have time to figure out who the heck he is.)
