I spent a week in jail for finding a lost cellphone...legal recourse? [Thread Fail!]

In the past I have found a wallet on the street and not returned it immediately. It sat in my backpack a few days until I saw a police officer stopped and I gave it to him.

Whether or not OP is lying I am surprised at how many people in this thread would have been happy to call me a thief because of my actions and throw me in jail. Sounds like I should not do a damn thing in future if I see someone's forgotten wallet, phone, or other stuff.

As far as to all the other questions since I went to bed last night...READ MY POSTS!!! ALL OF YOUR QUESTIONS HAVE BEEN ANSWERED!!!

I had every reason to NOT leave it with lost and found...don't trust them with something like this.

The lady knew I had the phone because when I found the phone I asked the employee in that isle if it was his phone (since Ive seen them leave their phone laying around to check texts and shit when working)...he said it wasn't his.

This employee pointed out my girlfriend out to the cops when they arrived. Thats how they knew it was me and where to find me.

As far as "it takes 2 minutes to buy snacks and leave"...you people obviously don't have a girlfriend and/or don't have one that likes to walk around Walmart for an hour because she likes looking at every damn thing in the store.

As far as being a thief in the past, I really don't give a shit what you say. Haters will always hate.

This thread is not going to turn out in your favor. I would have it locked and move on. You are not doing yourself any favors and you cant fight all of ATOT by yourself. Many have tried and they all wind up failing when they are haunted for years no matter how much they "dont care". One day you will care and you will have wished you heeded this warning.

As far as your legal problems, dont trust your court appointed lawyer. Its up to a judge to decide if their evidence is sufficient to prove you guilty. Your "free" lawyer wont fight it out, he will plead you out. Trust me on this one. They never go to trial, unless its a death penalty case. He will plea bargain because he doesnt have time to waste on people who dont put food on his table. :'(

Simple solution (what I did last time I found a lost cell phone):

Before turning the phone in, call the last number dialed. Ask the person who answers if they recognize the number and to please tell the owner that their phone has been found and is waiting at the Wal-mart lost and found. Make the call in front of the customer service employee and give the person on the phone the name of who you are leaving the phone with.

Leaving the store with the phone was just stupid and no judge in the world is going to believe that you intended to return it.

So the OP went to the store to pick up some snacks, found a phone, person who lost phone remembered exactly where she lost phone, realized it wasn't there(and it did not occur to her upon not finding it that maybe she left it elsewhere), went to security, found someone in security, found a video over the exact spot where she lost phone, figured out exactly who it was who took the phone, went through surveillance to figure out that he left and where he went, grabbed two cops and found him in the parking lot?

That's the best 1AM surveillance crew ever assembled. EVER. And I'm not just talking about Wal-Mart.

Of course this time line is only believable if the OP and his GF are the slowest 1AM snack shoppers in the history of 1AM snack shoppers. (i.e. the OP was smoking at his car at 6AM outside of Wal-Mart)

No matter the intentions, I think it's really sad that you can be arrested for picking up a personal phone that's on a shelf and walking out of the store.

Apparently its an ordinance thats a subset of the Georgia Shoplifting laws.

One would assume an admitted shoplifter would be very well aware of the local laws...
