If they don't give you the game, if you paid by credit card hit them with a charge back.

You'll probably lose in the end but at least you'll waste their time.

What I want to know is why the hell they have to take the game out in the first place.

I watched them put the first two in but I was getting distracted because I kept on talking w/ wife about where we were going next, etc. etc.

I still don't think I should have watched him, the expectation is that when I purchase something it is in the box

It's like bringing home a tv with no tv in the box

I feel your pain, it does suck and you shouldn't have to pay close attention to make sure you get what you buy.

not to make light, but if a person could buy an empty tv box and take it home thinking there a TV in it, they'd have a SERIOUS problem lol

Looks like you earned the right to download that ROM and play it on the R4DS. Don't worry, it'll be our little secret.

I made a very informative post on this topic in this very thread.

Chargeback. Although he could do that if he paid with a CC at a B&M store.

ahhh, so I called in this morning and was very polite, I just said that I came in w/ wife and got some games and was literally about to wrap the things when I happened to open it and noticed no game in. He said to just come in the store, luckily it was same manager guy who checked me out yesterday, but I don't think he recognized me anyway.

Either way, he took the empty box and handed me a sealed DS game =)

I'm half tempted to open the sealed game just in case lol, but they are keeping my business =D

This is why I only buy unopened new. Which usually means I'm shopping at best buy or target.

Last time I bought a game from a B&M store I was buying the "Gold" version (of ArmA) and the guy at checkout put in the regular one (no expansion).
Luckily I was paying attention and noticed so I managed to sort it out, but clerks do make mistakes, it's just a fact of life.

My brother bought a sealed, new DVD at Target. The case was empty. He had a devil of a time convincing them to give him a new DVD, but he did get one finally.

Because you're unable or just too lazy to open the case before you leave the store to check for a disc infront of a clerk?

When I worked parttime at Gamestop in the summer of 2007, I had one or two instances where I forgot to put a used game in the case. Sometimes it just gets so hectic, and a customer will be buying multiple used games, it's easy to skip over a box and not think a thing about it. After the first time or two I did it, I always double-checked every case as I rang them up. Any time we ran into the issue where someone came in and said the disc wasn't in the case, we did a quick check of inventory, and it always checked out from what I remember.

As for those links above where they are talking about the reps not questioning obviously stolen games, the store and surrounding stores where I worked took it very seriously. At the time, we simply kept a list of people we were 95% sure who brought in stolen games...that list was taped right behind the shelf where customers couldn't see it. You had to take people's ID in order to take back used games (state law, they consider Gamestop to be like a pawn shop around here). If their name matched one on the list, we had right to refuse to take their games. Granted, if we ended up in that situation, we'd lie about why we couldn't take them in trade, since it'd probably be bad if we called somebody a thief when we had no proof.

I know of multiple instances where you could easily tell that somebody was bringing in stolen games, because they'd bring in 4 or 5 games, all that were brand new (within 2 weeks of release), and nobody in their right mind would buy $300 worth of games and come in to get $80 in cash. Ya, they'd always ask for cash, that was the second tell-tell sign. But whenever a store would have someone trade in like this, they'd immediately call all the other stores in the city (only 4 stores at the time), and warn them. Many, many, many times was my store warned, and lo-and-behold that person would come in...we'd just tell them no, and they'd leave.

No, because I simply should not have to. It is a lame process that assumes all customers are thieves. I refuse to be labeled a thief for walking into a store.

Bust Buy has no problems just letting you grab your own game, walk up and pay for it. Why can't gamestop? Because they don't trust you or their employees.

I also refuse to use self checkout lanes in stores. Because I am not getting a discount for doing the work. Give me a discount and I'll consider opening my cases at the store to make sure those kids did their job, and checking myself out.

Stop being so bloody melodramatic. I don't consider you a thief, but I would still lock my doors if I lived in your neighbourhood.

So they didn't scam you, they made a mistake.
