I never said I was anything. I just said I had plenty of experience with the law and legwork behind DV. If you've a problem with that then maybe a good shrink can help?

Reality is tough, but I trust my own knowledge in this incident as well as others that deal with it on a daily basis. There was no threat, you take it as you want. Anyway, regarding the issue, this is not about airing problems to your family, its about her safety. Although you may know certain things about the law, you also do not know how a judge will react to this particular case. Your advice to keep this quiet will put her in the same danger she was in before she got punched. There are many other factors here that the law also covers, including mental state, not meaning he is insane, but rather overly aggressive, that you have no covered. I would like to hear your opinions on what you feel that a judge would do, rather than what the laws state. And please do not tell me that the judge would simply enforce the law, because you know that it is not always the case.

What does his mental state have to do with being arrested for battery or hers? Being arrested is totally different than being convicted, and no one has even said she'd be convicted. However, it was stated that most of the time both parties are arrested. What would a judge do? That varies wildly. One might have it in for her, one might have it in for her BF, the judge might be nice to both, the judge might throw the book at both. Now that's assuming a jury doesn't get to make a recommendation, or if the judge doesn't have to follow min/max guidelines.

I have to say I agree with you on this point. I realize now when u say get arrested, you did not mean get convicted, and I jumped to that conclusion. Your advice from a legal standpoint is completely right, but I guess I wish there were some other way to solve this.
