I said I was going to bed, but I'll answer this real quick. The possible penalties for battery are pretty tough in Cali, and the risks outweigh the gain for her. Even if he had a record it would only make it worse for her. I'd get a restraining order against him and maintain a policy of never speaking to him again. I certainly wouldn't want a battery conviction on my record because I felt I could get someone else in trouble too. I'd be prudent for her to drop this unless she was less than clear in her story. ohhhh I got special mention....but really geek boy, I never claimed I did anything like hit someone's car with a brick and they just drove away. I speak a 'little' more truthfully here. You hit someone's car with a brick, they will try to fight you or run you down or have the whole police force there...they are not just going to drive away.

Mill you are a moron. I just wanted to talk face to face, and I merely told u my height and weight because you were obviously uninformed in calling me a "little man". There was no threat, you take it as you want. Anyway, regarding the issue, this is not about airing problems to your family, its about her safety. Although you may know certain things about the law, you also do not know how a judge will react to this particular case. Your advice to keep this quiet will put her in the same danger she was in before she got punched. There are many other factors here that the law also covers, including mental state, not meaning he is insane, but rather overly aggressive, that you have no covered. I would like to hear your opinions on what you feel that a judge would do, rather than what the laws state. And please do not tell me that the judge would simply enforce the law, because you know that it is not always the case.

yes, but you're forgetting that equality in the workplace is different from equality in strength during self-defense/fight. I mean, i do agree, if a woman goes all out and bashes the guy with a bat or something, or just nails him, he has the right and perhaps the need to defend himself. However, Dezign just slapped him to shake this crazy back into the real world, she didn't warrant what he did to her.
I mean, i agree, spousal abuse isn't just a one way street, but you telling Dezign to "rethink" her ideas regarding self-defense is a little out of place. She didn't say she was a proponent of women being able to fight and men not being able to retaliate.

she could have walked away, left the apartment, a million other things than physical attack...I would have attacked....however, I'd probably also take the risk of sitting in jail for a few hours until someone came and got me.
However, it is never the right thing to do to hit anyone...even touch them in a confrontation. 9 times out of 10 if you had a way to flee but engaged the other person you can be found guilty of assault....whether you just 'escorted' out, slapped, punched, or hit with the proverbial brick.

Don't have time to read the whole thread right now, but...
With the kind help of an LAPD officer, I was given the information necessary to file a report (noting the incident occurred, so if anything of the sort even comes close to happening in the future, it will be dealt with appropriately), and will be doing so this evening or the next, at the latest.
I've saved several voicemails and e-mail messages that should be sufficient evidence.
I will be 110% truthful with the officers, and hope nothing of the sort even comes close to happening again.
I realize I've demonstrated some piss-poor judgement, and will be the first to admit my mistakes. I'm not perfect, but I learn from life's lessons... particularly this one.
Thanks to those who offered helpful information, most of which occurred via PM.

Did you forget to take your meds again? I said in the beginning of the thread why I knew about domestic violence issues and why I knew the timeliness of how enforcement of said issues had progressed(CJ major). Also, I use a lawyer quite regularly, but I'm not even sure what that had to do with this thread??? I'd never use one that was a friend or family member because my life is none of their business, I don't need to use a generic 2 dollar lawyer, and I already have several that handle my business that are on retainer.
If that's not a case of projection then I don't know what is. I consider Dezign to be a good person(I've talked to her plenty via PM) and she knows I have nothing against her. I just think she made a very bad decision and that she should try to protect herself. Now I'm not sure why you are telling us you are genius level? What does his mental state have to do with being arrested for battery or hers? Being arrested is totally different than being convicted, and no one has even said she'd be convicted. However, it was stated that most of the time both parties are arrested. What would a judge do? That varies wildly. One might have it in for her, one might have it in for her BF, the judge might be nice to both, the judge might throw the book at both. Now that's assuming a jury doesn't get to make a recommendation, or if the judge doesn't have to follow min/max guidelines.
