If those two dead guys made a choice to go on that robbery with their brotha, then it was their own choice that put them in harm's way and got them killed. In other words, they made a conscious decision to break the law and died because of their own choice.

In all seriousness.... I don't think Hughes should be charged with the death of the two people that he did not shoot, however, he should be charged with Attempted Murder, Assault with a deadly weapon, B&E, Trespassing, and whatever other crimes he may have committed. The death of the other two people who broke into the house is not murder, it's self defense.

Also, as far as the "they were fleeing" argument goes. They broke into the house and beat the crap out of the guys stepson, he did what he had to do to prevent any further harm to his family.

I don't really understand why the third guy is getting charged with murder though. I don't think anyone should. He should get charged for breaking and entering and any other law which he broke and there should be no charges against anyone for the deaths.

edit - I read more of the article, the third guy being charged with murder is in compliance with the law. He created a situation that could cause a 'fatal response from the homeowner'. I have no sympathy for these guys, atleast two of them got what they deserved.

Usually, the reasoning is something along the lines of when a death occurs during the commission of a felony, if it can be shown that the death happened due to the actions of the felony activity, then the person responsible for the felony activity is also fortunate enough to have the death attributed to him as a murder.

I don't see anything wrong with that line of reasoning.

The attitude of using "anything you can" to get a harsher penalty seems dangerous to me, and renders the legal system vulnerable to future abuses.

I agree with the gist of your post, but there is already a ton of precedent for the charging him with murder. This is not nearly as rare as the article states/implies.

I see your point, but that is crossing a dangerous line which could be abused. I just hope the courts heavily consider that before making decisions on a case by case basis. Regardless, if you play with fire then you may get burned.

an example in denver about 8 years ago a woman got two friends to break into a storage unit to get her stuff or something like that. cops got called, her friend takes off with her in the passenger seat police chase starts. guy driving shoots at cops during the chase. he crashes his car and takes off. the girl is still in the car and is taken into custody. cops surrond a apartment complex and while sniffing him out he shoots and kills a denver cop and in the process gets peppered by swat and is dead as well. the chick who is in custody and is sitting handcuffed in the back of a police cruiser while all of this is going on is charged with murder and got 20 years. the reasoning was that if she didnt mastermind the crime by getting her psychotic friend to help her none of would have happened.
