3 guys break into a house.

3 guys proceed to beat the owner of the house son with a baseball bat to the point that he has brain damage so severe that the 19 year old son can no longer feed himself

Dad shoots two of the three while they are still in his home

Someone has the damned nerve to say he had no business shooting them????

Did I miss something? Only thing I think that they should do to the homeowner is give him 30 hours of court ordered gun training. None of those bastards should have left that house breathing our air.
 
I don't think he should be charged with the two deaths. If those two dead guys made a choice to go on that robbery with their brotha, then it was their own choice that put them in harm's way and got them killed. In other words, they made a conscious decision to break the law and died because of their own choice.

Now, When you say "out of bullets" do you mean you will empty the rounds from your firearm(s) and then stop, or do you mean you will reload a bunch of time until you have used up ALL of your ammo? Or do you mean you will use what you have, and then repack the bronze, then use them again, and keep repacking the bronze until you run out of powder, caps, or lead? Will you burn through all your practice ammo too? How many rounds do you have? If you have like 1000 rounds, that means you'll have to reload a ton of times, what if you have to go to the bathroom when you are reloading? Will you piss on the corpse in the middle of your shooting? When the cops eventually come due to the almost constant sound of gunfire, will they rule the cause of death to be lead poisoning? Will the corpse just be a pile of lead and ammonia with random gibs of flesh? Also, what about non-Canadian Eskimo's. If a non-Canadian Eskimo broke in to your house to steal all your whale oil (which I assume you do not have), what would you do?


In all seriousness.... I don't think Hughes should be charged with the death of the two people that he did not shoot, however, he should be charged with Attempted Murder, Assault with a deadly weapon, B&E, Trespassing, and whatever other crimes he may have committed. The death of the other two people who broke into the house is not murder, it's self defense.

Also, as far as the "they were fleeing" argument goes. They broke into the house and beat the crap out of the guys stepson, he did what he had to do to prevent any further harm to his family.
 
Meh...this wouldn't be a big issue if it were 3 white guys breaking into a white guys house ending with the same result. I don't really understand why the third guy is getting charged with murder though. I don't think anyone should. He should get charged for breaking and entering and any other law which he broke and there should be no charges against anyone for the deaths.

If someone breaks into your house, shoot first and ask questions later.
 
Wow....I agree though. You break into someone's house and beat someone like that, you deserve whatever comes to you. When you initiate violence, you deserve to get some in return.

edit - I read more of the article, the third guy being charged with murder is in compliance with the law. He created a situation that could cause a 'fatal response from the homeowner'. I have no sympathy for these guys, atleast two of them got what they deserved.

Usually, the reasoning is something along the lines of when a death occurs during the commission of a felony, if it can be shown that the death happened due to the actions of the felony activity, then the person responsible for the felony activity is also fortunate enough to have the death attributed to him as a murder.

I don't see anything wrong with that line of reasoning.

The attitude of using "anything you can" to get a harsher penalty seems dangerous to me, and renders the legal system vulnerable to future abuses.

I agree with the gist of your post, but there is already a ton of precedent for the charging him with murder. This is not nearly as rare as the article states/implies.

I see your point, but that is crossing a dangerous line which could be abused. I just hope the courts heavily consider that before making decisions on a case by case basis. Regardless, if you play with fire then you may get burned.
 
It's a stupid defense saying that they were shot in the back.

Of course they are going to run away when a gun is pulled on them.
They should still get the bullets in the back. How do you know they won't come back with a gun for revenge?
 
an example in denver about 8 years ago a woman got two friends to break into a storage unit to get her stuff or something like that. cops got called, her friend takes off with her in the passenger seat police chase starts. guy driving shoots at cops during the chase. he crashes his car and takes off. the girl is still in the car and is taken into custody. cops surrond a apartment complex and while sniffing him out he shoots and kills a denver cop and in the process gets peppered by swat and is dead as well. the chick who is in custody and is sitting handcuffed in the back of a police cruiser while all of this is going on is charged with murder and got 20 years. the reasoning was that if she didnt mastermind the crime by getting her psychotic friend to help her none of would have happened.
