You can't fake HGN.


We don't typically give a preliminary breath test roadside. The 'official' breath test machine requires an operator to take a three day course to become certified, plus routine testing/calibration/etc to ensure accuracy of the equipment. Roadside PBT's don't undergo the same scrutiny and won't hold up in court.

Based on the facts and circumstances present, would a reasonable person believe that you were under the influence of alcohol or a controlled substance while in control of a motor vehicle? If yes, there's probable cause for a DUI arrest. I would request a blood test and if you refused, your license or operating privilege would be automatically suspended by the State of NH. You could appeal (and possibly win) the hearing, but after you pay towing fees, legal fees, and the citation you're sure to get from the original offense, you'll wish you weren't a dumbass.

However, I can't tell you first hand - I have yet to run into someone that stupid.

Yeah, but arguing with fleabag was humorous and amusing. Arguing with theflyingpig just seems hollow.

fictional scenario:
You havent been drinking all week.

cop pulls you over for minor traffic violation. (15mph over speed limit, failure to stop b4 turning right on red, brake light out, etc.)

he asks you the standard question of 'have you had anything to drink?'

you lie and say you've had a couple beers in the past few hours.

He asks you to step out of car, and run you thru a few field sobriety tests which you fail on purpose. (remember, you havent had anything to drink for days.)

then he gives u breathalyzer, which you blow 0.00 since you havent been drinking at all. (for legal reasons the breathelizer is usually given AFTER the field sobriety tests.)


So whats the worse that can happen? (JLee?)

actually happend to me, but i DID have one shot for my friends b-day.....got pulled over leaving the bar. did three tests, then blew a 0.0 in the breathalizer.

Her is my thing. If they performed the thee tests that fthey failed horribly in. That right enough to have some arrested and taken to jail. where you will have a stay at the hospital for some testing. You come pissing clean water. Well Now I have another test to give you. Same you had before. if you pass it with flying colors At this point it's safe to say the DWI charge is mount; But what had taked away must be reterned. You'r new charge is RDo. RDO put out in its simplest forms you keekp the officer from completing his investigation. That is illigall and I will take you straight home that nite. RDO charge you be spending least the night enjail before someone comes and gets you.


Keep mind even if you dont get convicted wannt to explain to feature boss why these charges are on you record situation happened//?

"I believe the police have enough right to arrest someone and take them to jail simply based on failing the field sobriety tests. If they don't take you to jail or if they require more evidence, they will take you to the hospital for some urine or blood testing. At this point, the DWI charges should be moot if you passed the additional tests they performed. However, they would likely charge you with RDO (not sure... reckless endangerment or some form of obstruction?). This new charge would probably result in you spending a night in jail. Either way, it would not be fun to explain why you got arrested if your employer happens to perform a background check that shows the arrest.

I hope this makes sense because I just worked a set of twelve hour shifts. What I haven't told you is that I also got completely shitfaced right before posting this to top it off."

Cop pulls you over for speeding 55 in a 45,
asks to see registration , you tell him its not your car.
He asks to see your drivers license, you tell him you don't have one.
he asks if there are any guns in the car , you tell him "only the one in the glove box".
he asks "you have a gun in the glove box?" you respond, "yup and there is a body in the trunk"
He tells you to sit still and don't move he is calling in his supervisor. You comply.
Supervisor arrives on scene and asks you "is there is a gun in the glove box?" you calmly reply "No"
Supervisor asks "do you have a body in the trunk sir?" you reply "no"
you signal to the supervisor to lean in closer and tell him "I bet he told you I was speeding too!"

You can still get arrested for a DWI because you are mentally and/or physically unable to operate a vehicle. Since you are not refusing a breath and/or blood test at the station they can't take your DL. A breathlyzer in the field can't be used in court as evidence.

Since they can't prove it was alcohol and assuming you have no drugs in the car or on your person I doubt you would get convicted.

I dont know if anyone has suggested this but one can also give a police officer the finger and tell him or her to fuck themselves. Done with a smile of course and in a non threatening way. Care to see what will happen when you express your consituionally protected right of speech and expression - at / to a police officer? I will bet you a beer that it will not end well - even if it is your 'right'.

I believe this question is winding its way through the American legal system and will inevitably end up at the Supreme Court.

And individuals freedom of speech / expression versus law enforcement's right for self protection / intimidation / ability to do their prescribed job. Whatever their claim is it has yet to be set in stone and thus not a wise course of action.

But yes - fuck with police for shit and giggles. Always a smart move wherever you live.

Just because you could in theory doesn't make it a wise or clever or even right move.
