the 911 operator is an idiot.

why is the 911 operator an idiot?

He called and said my house is being robbed, I just drove off in their van!

She says stop the van, you can be charged with grand theft auto.

and?

thats idiotic.

no it's not. if a burglar tries to rob you and you end up robbing him instead, that's a crime. the law doesn't account for revenge...

He was removing property from his property.
He didn't give them permission to park the van on his property, so he was moving it off his property.

That's why it's best to simply shoot them with a shotgun. They were attacking you so it's self defense. And since they're dead, your side of the story is all there is to go by.

Where was he when he called? It sounds from the tape like he had just fled in the van. Was he supposed to stop the car in front of his neighbors house and get out?

Yes if he had kept their van and tried to sell it or live in it or turn it into an ice cream truck he would have been charged, but there was no reason for her to tell him to stop the van. She should have had him driven a safe distance away, or driven to a police station.

Fsck cleaning that up.

If I was in a basement and people were robbing upstairs, I'd grab my shotgun, get in their van and leave.

I would have just taken their keys and thrown them in the bushes.

No way - them burglars may have kicked my ass for tossing their keys. This way, I was in fear and bolted and they could not catch up to me unti lthe police arrived to arrest their punk asses.

lol yeah sure.

Bottom line: it was grand theft auto. Should he be charged? Hell no. Will he be charged? hell no. Could he be charged? absolutely.

No. It was prevention of a felony in progress.

Now, if he had hopped in the car and driven to the nearest chop shop, it would be theft.

Well with people getting charged for helping people by removing them from car accidents these days you never know what can be done to you for doing this.
