even IF this guy was going to be charged....there are probably a hundred lawyers that would take his case for free......then turn around and sue the city and win.

Somehow, I don't think your destination has anything to do with whether or not driving a car that does not belong to you without the owners consent is theft..

It is obviously theft.

I agree with thepd7 says; he wont be charged but he could be.

no it's not. if a burglar tries to rob you and you end up robbing him instead, that's a crime. the law doesn't account for revenge...

He was removing property from his property.
He didn't give them permission to park the van on his property, so he was moving it off his property.

Bottom line: it was grand theft auto. Should he be charged? Hell no. Will he be charged? hell no. Could he be charged? absolutely.

No it wasn't, it was left on his property by trespassers and he simply removed it. Actually if anything the burglars can take him to civil (small claims if the car is a POS) and sue him to get it back, since it's a civil matter.

Very funny. Personally there would be bodies... but taking the van was the thing to do for him. Illegal? Yes. Theft is theft no matter where. I tend to doubt he drove around and probably just circled the block and waited for the police to arrive.

I don't know if going on the local news channel and rubbing it in the burglars' faces is the wisest course of action.

Look the bottom line is this guy is not going to be charged but the operator was NOT an idiot. She did everything correctly as far as I am concerned.

Come on AT "Lawyers". Is there no precedent for something like this where a victim of a crime uses the perp's vehicle to get away? What if you were kidnapped and stole their vehicle to get away? The van was on this guy's property too and he removed it off his property and then proceeded to call the authorities. Not that he would get in any sort of trouble, I am wondering if he could by the letter of the law. I heard of cases where robbers were injured robbing someone's house and they sued the homeowners. I think I remember a case in NJ where a robber was shot in the back while trying to flee a house he was robbing. The homeowners who shot him were sued (I don't think a criminal case was pursued but it may have been possible under excessive force or some crap).

I thought someone had broke into my house last night. I heard a noise like someone dragging our tv stand out downstairs. I can't help but think how stupid I looked running downstairs in my underwear with a loaded AR-15.
