I would first let them know that I understand that it was most likely an accident (add some comedy in there about how it's possible the guy didn't like you or something)... but also add that it's an accident that could have lead to a very unhappy family.
Ask them how they would have felt if it was one of their personal cars, and what if the same thing would have happened to them..
Sue the ****** ouf of the guy you talk to, the mechanic, the dealership, and the owner of the land the dealership sits on.

Your mixing civil & criminal law issues here. If we pass laws making loose lugnuts a criminal offense then you might have a point.

If nobody got hurt, GM would be liable for replacing the defective tires - just like Firestone/Ford were a few years ago. If somebody does get hurt, then they are liable for the actual damages - just like Firestone/Ford were a few years ago. Using your logic, everybody who had tires replaced in the Firestone fiasco should have gotten a huge settlement because they were *potentially* at risk, even if nothing happened.
I don't think you really want our legal system to go that way. The tort system is bad enough as it is - to open it up to this kind of thing would be insane. You are exposed to risk of varying degrees everywhere every day. So instead of getting sued out of your life savings because somebody actually did trip on a crack in your sidewalk, you'll now get sued because somebody almost tripped on a crack in your sidewalk?

Ohh I'm not gonna share. And I am too lazy to type out any explanation so you can understand. Lets just say the level of entitlement in this thread is alarming. THe wheels should be fixed, an apology should be made and people should move on. The OP isn't ENTITLED to gas/time/homework for the next 24 months/first born of the mechanic/lifetime supply of windshield wipers/orwhatevertheheckelseyoucanthinkof. Yet it appears that some of you think he should really reem the dealership.

I had a spare tire nearly fall off when I was driving a few years back.
It started wobbling like crazy and I pulled over immediatly. The bolts weren't even hand tight. It was all my fault though.

go back to P&N tool. You aren't fooling anyone here. This case will not meet any standard of care for awarding punitive damages in any court. OP would at most get reimbursed for the cost of the services and any damage to his car. This was not done with any malicious intent. There was negligence, but short of someone being injured, they courts do not care.

in High school a couple of idiots who I didnt know very well loosened my rear lugs on my car while parked at the school. I got about half way home and my car started shaking really bad so i pulled over. I had rims and saw what the problem was so i jacked up the car and tightened the lugs but a couple of the studs were stripped.
So i was wondering how in the hell did those lugs get loose, until the very next day these two idiots came up to me laughing like it was the best joke ever and said "so did your tire fall off" pissed is not the word i would use for how mad i was. I got home that night and told my dad what happend. Pissed is not the word i would use for how mad he was. He called the principal and both of those idiots got a week suspension and then my dad went to their parents and got them to pay for the damaged studs.

Not to be mean, but you obviously know nothing on the subject. You DO NOT use an IMPACT WRENCH with 100+ lbs of pressure to tighten your lugs.
i wouldn't go in calm like nothing happened, be stern. they are a dealership and this type of stuff isn't supposed to happen. there is a such thing as professionalism.
yes, the mechanic or whoever is supposed to check the car before they released it should be fired. they didn't do their job and it could have resulted in an accident. When you're dealing with 3-5 thousand pounds of metal that can travel at a high rate of speed, "oops" doesn't cut it. Do you think that if their insurance company found out about this that they wouldn't be a little concerned?
they should replace all the studs. not just the visibly damaged studs but all of them. there is no telling what unseen damage might have been done to the "good" studs. They will probably also inspect the area if anything else was damaged. They should also offer you a substantial discount (not the 10% - 15% that dealerships mail out every so often, at least 20%) on future maintenance. You did spend extra time, gas, and money to deal with their mistake. I would not expect a new set of tires, I would hardly expect a single new tire.
So far they don't sound shady, so I think that they'll be fair as long as you don't go in there and start demanding a new car every 2 years with free maintenance for life 😉

He means that they don't tighten them as tight as they can. Each car company (I think it depends on bolt pattern) have a specific amount of torque that each nut should be tightened at. For example, the majority of Lexus cars need to be tightened at 76 ft-lbs in a 1,3,5,2,4 order

I do if someone else does something to my car that requires them to pull them.
