What'll happen probably depends on your state laws, and while a lawyer might be a good idea they are not necessary.

I got busted along with two friends several years ago for about as much pot as you guys had. Two of us got lawyers, the other kid didn't, and all of us ended up with the same punishment. The possession was dropped in favor of usage and we had to take a day class on drugs or something (I forget what it was). Had to pay a fine ($100-$200 IIRC) and be on probation for six months, which amounted to me sending a sheet of paper to the probation officer with my address on it (I was three hours away at school).

All three of us were under this clause:
Section 7411 of the Public Health code provides for a plea without conviction for a first offense on drug charges. If the defendant is accepted under 7411 and completes a period of probation the case is dismissed at the end of probation without a conviction. The use of 7411 is within the sole discretion of the judge and applies to possession and use cases.

A lawyer can have the charges reduced to something less offensive and less future-injuring...possibly even thrown out. You can't do it on your own unfortunately.


he wont need a lawyer for that if its a first offence, it wont even go on his record and he will most likely just have to pay a fine.court fees depending on the state

i work for wachovia bank, by SEC rule, i got a background check. i'm in network, but since it is in securities side of the business, i imagine even the helpdesk have to get one.

i don't think HR care about drug usage here.

The financial industry is notorious for not caring, because cocaine works better than caffeine as far as raising productivity on the trading floor.

WRONG. IF it goes to court and IF they charge him with possession of a controlled substance, it will stay with him for life. He is over 18 and an adult.

How the hell am I so sure? B/C in the 1980's I got arrested for ONE JOINT and was charged with misdem' possession of a controlled substance. I was fingerprinted and photographed. When I went to court the judge dismissed it b/c it was a first offense and I had no previous record at all. Dismissed; no fine, no community service. And guess what? More than 20 years later it's STILL on my permanent record and shows up every time someone does a background check on me. Believe me, as a responsible, tax paying, clean living (since the 80's) adult it SUCKS having to explain my youthful indescretion every freaking time I apply for a job.

If he gets charged, he will need a lawyer.

i got cought with over an ouce when i was 21 in 2002, i didnt even have to pay a fine and its not on my record, no laywer involved

edit: my roomate in school got cought with some wee a bong and a bowl (wernt actually smoking) just possession, he did the court thing but none of it is on his record, he paied some fines and did some community service/ random drug tests for 6 months and it all went away

Smoking pot is not a big deal. But you didn't get "busted", you really did get busted. For real. In real life. The real thing. It happened.

In the future don't self incriminate yourself.

If you've got a Stafford loan or any sort of loan from the government you can kiss that goodbye, assuming charges go through.

Yup, its off my record because I followed through with it. Had to pay a lawyer about 2k though, well worth it.

OK i don't care much about anyone smoking pot. from what i have read its less dangerous then beer (and has positive health benefits for some) but man smoking it in public? bwhahahah i really have no sympathy for you. lol

Yep...I did this once (on a dock a couple days ago on the lake) and cops showed up on patrol literally 10 seconds after we finished what we were smoking. Just smoke somewhere private (it can be public, just make sure you can see trouble coming and there's no one around).

But if it does go on your record, just dont "accidently omit" it from an application.
