1. If she was my ex, she wouldn't still be anywhere near me.

2. If she was my ex and she took my car without permission (like I'd give an ex permission in the first place...), she'd be hooked & booked for auto theft. Not to mention the cite for unqualified operator.

3. If she got into an accident or something *while* doing the above...she'd have an extended stay at the gray bar hotel.

Explain that you would be liable for anything that happened and you choose not to risk that. And ask her if she truly understands that you will call the cops if it happens again, because if she does it she'll have no one to blame for the consequences but herself.

that's pretty much exactly what i plan to tell her...hopefully it sinks in, cause i would hate to have to actually do that.

Then stop bitching and throw her out. Tell her it's not acceptable to take your keys, if she does it again, call the cops on her.

Check your insurance policy, it may have more coverage than you think.
Also I don't believe that any accident is automatically the unlicensed drivers fault. Sure they will have traffic infractions due to driving without an operators license, but I don't think the fault will fall on them no matter what.

Threaten to kick her out if she pulls stupid sh!t like that again.

hey...you would know what's going on here...if she had been in an accident, could they have come after me?

i would assume so, since the car and insurance are both in my name

Don't say it unless you mean it. She'll only respect you even less than she already does.

I have friends who went through the same kind of thing. Daughter's bf was a real eff-up. They broke up because he is a douche, but her parents being the nice caring people they are agreed to let him continue living in their house until he could stand on his own two feet. And then he stole $300 and they kicked him out anyway.

You can't help people that don't want to be helped.

Unless you hang her out to dry, yeah you'd be screwed too. Either you say she stole it (which she technically did) or you accept responsibility for letting her drive it.

I don't believe you can get blamed for what another person does behind the wheel of a car.

Wow. There's some very high horses in this thread...

Don't make a statment like that without your own viewpoint or backing it up. We have other words we could use to describe that behaviour :p

So ggnl what would you do?

I wouldn't dump her or have her arrested

you can when it's your car and you never should have let the person out in it in the first place...which is the situation in the eyes of the law unless i say she stole it

This is a VERY good point

I'm an attorney, and I'm confused as to how an accident is automatically someone's fault if the person is not driving with a license. In Texas, even an unlicensed motorist would benefit from your coverage under our permissive use doctrine.

What state are you living in? Are you sure this is right?

You shouldn't leave your keys out where other people can get them if you can't pay up to any consequences.

Drop her off at the DMV, and don't let her back into your place until she has a card in hand.

if you let her stay in the house still you have no right to complain, you shouldn't have to hide your keys in your own house, but if you let her stay you're accepting the risk. If it happens again and she gets in an accident before you can report it stolen, and the other party finds out this has happened before, you're fizzzucked

This sounds like a job for biometric security! Dun dunn duhhh dahhhh! If she "took your car" then she's unfortunately prone to do other stuff. Its completely your decision to let her stay there, but take a precaution, get a easy to use safe to keep your keys and your valuables. Or get a lock for your door, so unless she wakes you up, she can't get into your room.

200$ gets you security, without a big hastle. don't worry about another key, just use your thumb.
