Friend failed to pull over promptly, speeding 45 in a 25 zone

Not a very fun experience.

Friend and I are driving home from seeing Star Wars ep 3. We are having a conversation about the movie, driving through a 25 mph residental zone. The zone is a really slow 25 mph, its a straight wide road that really should be higher than it is. Anyway, while driving, he passes a cop car, I'd estimate him going about 35 mph

In anycase, the cop came after us, and signaled to pull over. My friend was either frightenend, shocked, or scarted, because he didn't do so for about 30 seconds. I myself didn't realize what was happening for the first 5 seconds or so, unfortunately. Cops pull us over, tell us to get out of the car and lie on the ground, then proceed to cuff us. They questioned him for a minute. I guess he was scared, as was I.

He did not in any way really give an intention to pull over.

The excuse he gave was that he thought it was a fire truck and was confused as it didn't go by him, and that the people in front of us weren't stopping. :confused: From what I could hear, it didn't really fly, but I can say its likely the truth. From the time the sirens were on, he slowed down to a 10-20 mph crawl (it was a 45 mph zone by this point), but never stopped, so I don't know whether his intent to escape was there.

After a few mins, cops (like 5 of them were there by this point), let us get back into our car. His nose started bleeding as he got in the car. He was given 2 tickets, 1 for speeding 45 mph in a 25 mph zone, and other for failing to yield to emergency vehicle. The tickets also had a mandatory municipal court appearance 2 weeks from today. We are both young drivers (he is 18 and in high school), and he has never been ticketed before.

The excuse he gave the cop was that he got nervous and didn't see the drivers in front of us pull over. For that 30 seconds he was driving rather slowly, but never stopped.

This is a really bad situation, could use some advice on how to proceed. Neither of us have told his parents yet.

Driving home at night
18 years old
Speeding in a 25 mph zone
Cop signals, driver doesn't pull over for 30 secs
Cops do their arrest thing
Driver gets a bloody nose
Ticketed for speeding and failure to yield to policecar

I did not see nor hear any sign of violence to be a cause of his nosebleed.

A bit more about the road itself: It really is a wide, long road that everyone speeds on because 25 mph is ridiculous for it. It's one of those rodes that just about everyone speeds on, and comps camp out intentionally. Just about everyone I know whose gotten pulled over has done so there. Obviously nothing that could hold up in court or anything, but more facts about it.

One thing to mention though is that he still has his provisional (17 year old) driver's license. It expires when he turns 19, he just hasn't bothered to go over to the DMV and make the switch yet. In the state of NJ, if anyone knows, do your points xfer over during this change?

why'd the driver get a bloody nose, snorting some cocaine before getting pulled over? :)

How to proceed? Voluntarily give up his license and go back to walking. The world needs fewer idiots on the road, converting your friend from driver to pedestrian would be a good first step.

It's not always illegal to not stop immediately to a cop siren. Check the law. A law firm that specialize in these cases is in order. I'm sure they'll drop the second charge, maybe both because of excessive force(to an extent).

I think you have to put on your hazards to show your intent to pull over. I'm pretty sure its there so the cop will follow you until you feel safe to pull over.

I got a ticket a few months back for 85 in a 50. I was going the opposite direction of the cop when he did a U-turn in the middle of the road and me being the dumbass I am, I tried to get away. I pulled behind the school that was the first thing I came to on my right and pulled around to the back. Anyways I'm sitting there with my car off when the cop pulls up and gets out of his car and tells me to get the hell out of the car. So I do, he grabs me by the back of the neck and throws me against a school bus I was right next to. He radioed in my info and said it was some kind of felony resisting law enforcement or something and he could take me to jail, but his mom is really good friends with my mom so he just gave me the ticket for 85 in a 50. Which still sucks, I lost my license for 90 days to go through the deferral program (35 over would skyrocket my insurance).

Anyways the lesson I learned from this is don't run from cops. Sorry your friend wasn't as lucky as I was though :(

At this stage, a plea is the best bet. Talk to the DA before the court appearance. Explain that even though he didn't pull over right away he didn't make any effort to evade the cops. He was scared, freaked out and froze for a few seconds. Agree to plead guilty to the speeding in exchange for the failing to yield charge being dropped.

He's not a bad driver. Usually he's pretty safe, like I said he's young and just panicked.

30 seconds is a long damn time....
It is, which is why I am worried.

How about, consult a fvcking lawyer and stop asking the internet for help on a subject in which we have no experience with?

Not a bad idea. Could we possibly plead guilty to a lower speed charge? The difference between 19 mph and 20 mph over is $105 to $200 here.

"not a bad driver" != 20mph over speed limit
"not a bad driver" != panicking
"not a bad driver" != failing to pull over for flashing lights

If he can't handle the car, can't obey speed limits and can't handle these situations as they arise he doesn't belong behind the wheel.
