I was on my way to college, on the express way, when I saw a police officer up ahead, all the way on the right shoulder, with someone pulled over. There are two cop cars there. I'm in the right lane because my exit is the next.

So I cruise by, obeying the speed limit, and all of a sudden, the second cop pulls me over.

I got a ticket for "failed to use due caution for emergency responder"? It's not just a civil infraction, but a 4 point misdemeanor. Apparently, I'm a criminal for not merging left one lane?:confused:

I used to have a perfect driving record too.

And 10 minutes later, my girlfriend calls, and was pulled over by the same cop, for the same charge!

Interesting law...not a bad idea, either. It's not a good feeling to be standing out there and have a car whiz by you and way too many cops have been hurt and/or killed that way.

Sounds like they had a trap set up. Talk about crooked. that's such a b.s. reason to nail someone. What if there was enough traffic that changing lanes wasn't easily possible? Were the "emergency responders" pulled far enough off to the right that they had plenty of safety room regardless?

Edit: Up here, when cops pull someone over, they park with half their car hanging out into the right lane! wtf??

It's getting more common in more states, although I didn't realize there was such a big penalty for it anywhere. Most of the ones I've read about it's more of a "courtesy" that is written into law but not usually enforced.

yes, the shoulder is quite a bit bigger than a lane.

Lesson learned. Next time you see a cop pulled over on the side of the freeway, slow down to 10mph. For safety.

Fl law requires merging over or ither slow down 20 mph if unable to merge over...you might be able to fight it on grounds that lane blocked, you had already sloweddown ,and that you were preparing to exit highway at the close ramp....you get to cross examine the LEO and if he is unable to answer whether tou were slowed, other lane blocked, or previous traffic stop was within a few hundred feet of off ramp.

4pts is a bit harsh...

florida state troopers have had a 100 extra cops on duty for the past week to pull over people doing exactly what you did. should watch the news....if ur in FL anyways.

I always thought it was just courtesy to slow down or move over. Don't the officer approach the car from the passenger side anyways?

4pts is a bit harsh...

The only thing I don't like regarding the idea of slowing down is what if another car's on your ass going 65-70 MPH and doesn't know about the law (like the OP?). If all of a sudden you brake down to 20-25, the car behind you might have to stomp on his/her brakes and ram you.

That is becoming a very common law and I agree with it for their safety.

If you cannot merge then you must slow down.

Yeah, to an extent. You're also supposed to angle the car so that you're covered by the engine as well.

But doesn't that increase the odds of some motorist smacking the cop car? And cause traffic snarls? Is it acceptable even if, to position your squad car as you say, you must be hanging into the traffic lanes? I'm not trying to belittle an officer's safety... dont get me wrong, I see the point and all but... seems like a lot of potential trouble could be avoided if cops could just go over to the passenger side. Why don't they do that? I've been pulled over a few times long ago and they came to my pax window, but I dont see that anymore.
