Apparently, Wendys fired all of the employees after finding out their lawyers didnt meet deadlines to file certain items that would allow the workers to be citizens. Wendys then had no choice but to fire the workers, abiding by law. Some of the workers had been employed by Wendys for 9 or so years, in hopes of becoming a citizen through Wendys employor sponsor program. $25 was deducted from their paychecks every week of their employment to cover legel fees. I understand that items were not filed and they have to abide by the law, but it seems kinda rotten to me.

No, they don't have the case. One's citizenship (or lack thereof) is one's own problem, not the employer's.

The INS should just scoop them all up in the courtroom.

You're right, but the company offers some company sponsor program which will help immigrants get citizenship through the program.

well, seeing that it was wendy's citizentship program that they were going through to get their citizenship and those were the attorneys hired by wendy's... i think the employer is partially to blame for not being dillegent on checking on the status of said employees citizenship...

Then they should have the $25 per check reimbursed.

Wendy's took it on as their responsibility to help these people become citizens, and it lied to them when they were told the papers were filed.

The negligence of the law firm is obvious, yet they still got paid. Citizens or no, the workers at least deserve a refund.

What's so hard about coming to the US legally then getting your US citzenship? Millions have done it for years the legit way.

The lawers did drop the ball bigtime though. What'd have just-out-of-law-school interns working on that?

Wendy's didn't own the company at the time. And no, illegals have no right to anything.

If they are legal resident aliens, they have a case, but probably little chance to win.

If they are illegal aliens, they shouldve been shipped off a long time ago... Hell mexico imprisons illegals in FPMITAP we shoudl have some sort of punishment for those like felons in this country. Sneak into country=illegal illegal acts should not provide rewards.

Actually, it takes quite a long time and it is difficult.

wendy's was the one who hired them on behalf of the employees. for that, wendy's was the employees fiduciary. they could show that wendy's breached such duty. the hard part is actually showing that wendy's was a fiduciary.

boy Wendy's is screwed. they are going to lose and lose big time. they won't go after the law firm (wich they should be the only one getting sued) because wendy's has the deeper pockets.

but i do agree that they should sue.they paid for something and didnt get it.

bingo. it's like a bank robber suing his partner because the partner didn't give him his fair share. There's a contract and everything stating the robber would give his partner a fair share.
