Some of you guys need to learn how to read things correctly. Illegal immigrants are totally different than people who do not have citizenship. Those people were here legally and were working for Wendy's and paying wendys $25 out of there check every week so the lawyers could get them citizenship. They got screwed over and they have a case now. If they were illegal, they would have not been working for a company like wendys. Get it now?

Wow, some of you don't quite comprehend this...

They were here legally and were participating in a program where they worked until they gained their citizenship.
Wendy's/their lawyers dropped the ball and their program expired before they became legal citizens, because the lawyers didn't file their paperwork on time. It wasn't until this point that they became "illegals."

They deserve to win this lawsuit.

seriously. typical ATOT...too quick to jump the "i hate illegals bandwagon". These people were here legally and were making a honest living and paying taxes. i really hope they win.

I think the goverment should crack down on anyone the hires illegal immigrants.
What's so hard about coming to the US legally then getting your US citzenship? Millions have done it for years the legit way.

The lawers did drop the ball bigtime though. What'd have just-out-of-law-school interns working on that?
and to those who ask "why dont these illegals
why dont you ask that to the lawmakers who made it INCREDIBLY difficult to come into this country legally if you dont know anyone already living here.
My uncle came here back in the 70's with nothing but the clothes on his back (literally) and now is a CPA, has his own business, and is very well off. He came with noone's help but that was easy to do back then. But since then, congress has passed many many laws that make it really tough to get any kind of long term visa if you dont have anyone vouching for you. My parents applied for green card when I was born. But it wasnt until my uncle sponsored us when I was 10 that that ball got rolling. Even then, it took 2 more years to get our papers. The process was quite expensive...even for a middle class family like us. Imagine what it'd be like for a dirt poor family that's looking to come here legally...it will be near impossible.

There really are only a handful of ways to come into this country legally
- family member who is already a citizen of US sponsors you. you pay lots of money
- work sponsors you. you pay lots of money but less than case 1
- you have deep pockets
so you either have to know someone, have skillsets that will make you attractive to corporations here, or be rich. None of these applies to illegal immigrants.

I am not defending illegal immigration...im just giving a reason why they come here illegally - cuz most of the people that come here illegaly have no chance to make it here legally. people who can come here legally, do.

As much as I hate Rush "analcyst" DrugAddict, he makes very valid points in that piece. Why should we treat their citizens better than they'd treat us under similar circumstances? Then again, I'd support changing the laws of our country to mirror the laws of other countries...Little things like immigration laws, customs laws, etc. If a country makes our produce sit and rot on the docks waiting to be "inspected", then we treat their imports the same way...let it sit on the docks and rot/rust...

No, they don't have the case. One's citizenship (or lack thereof) is one's own problem, not the employer's.

The INS should just scoop them all up in the courtroom.

Then they should have the $25 per check reimbursed.

Wendy's took it on as their responsibility to help these people become citizens, and it lied to them when they were told the papers were filed.

The negligence of the law firm is obvious, yet they still got paid. Citizens or no, the workers at least deserve a refund.

They deserve a refund, plus accrued interest. Beyond that, maybe an apology letter for being a typical-don't-give-a-damn-about-its-workers company.

The lawsuit should really be aimed at Boyar & Miller, the firm that Wendy's had hired to handle the immigration sponsorship program in 2001.
This story is obviouslly sensationalized to focus on Wendy's. Though both the firm and Wendy's should and will be held accoutable to some degree.

I believe this program is part of or an extension of the "LIFE act", which came about because of a few very old class action lawsuits against INS because of the 1986 Immigration Reform and Control Act. It's really just a long extension of avenues of appeasing uneducated, unskilled immigrants, looking for an "easy" way into the country. Reality is that even though they were part of this program, some of these immigrants had nearly a decade to discover other methods of becoming part of this country. Many really don't care about being part of this country or anything it stands for, all they want is the money.
