Desperately need advice on traffic violation

Let me tell you my situation here.. December of 2000 I was on the 5 south going down to San Diego and got pulled over for speeding at 101. I went to court they suspended my license for 1 month and had a fat fine of 505$.

On July 11, 2001 I was heading up north towards San Fransico on the 5 north, at this time I was 140 miles away from home (roughly around 2 hours away)in Bakersfield county. I got pulled doing 101 yet again. I tried to plead to the officer and also told him my situation. He was a heartless officer doing his job, he really didnt care for what the consequences I was about to face. Now I am about to experience maximum punishment I currently have 2 points on my record and about to face another 2 points. I have heard that I can get my license suspended up to a year and face a max fine of 1300$ Now the question is what can I do? I cannot afford to pay a fine that hefty nor getting my license suspended for a long period of time. Do I actually drive up 2 hours to bakersfield and plead to the judge face to face. Or is this a no contest, plead by mail? Is it possible for me to do community service. Will the cop even show up in court?


Ya you guys can laugh, flame, or even call me an idiot and what not. This is a serious matter all I care for is advice at this time.

Why even bother getting your license back? It'll take you another week till you get caught doing 101 again. So my advice is, just give up driving. Flame mode off.

Wow - in this case you really should at least consult with a lawyer as it sounds like you are in pretty deep.

If your going up there to plead for forgiveness, I wouldn't bother. If your going up there to contest the ticket based on evicence that the ticket was not warranted, then yes. But, what would not warrant this ticket? Were you really going 101 or did the office mis-judge that speed?


If you go up there, you may want to adhere to the speed limit. ;)

Not sure how it works in the States, but we have a few choices:

1.) Pleady guilty and take the Justice Of Peace and try and get the fine (the cost only, not points) knocked down.

2.) Go to court and put together a really good case, to point out any flaws in the officer's procedure or the actual speed you were going. Obviously, pleading not guilty. You could hire a lawyer too, if you have the cash.

3.) Plead guilty, go to court and prove to the judge that you have learned your
lesson and that you will change the way your drive and you feel stupid for your actions.

4.) Setup a "first appearance" with the prosecuter and do the same as you would in scenario #3, but without having to go to court.

I'd seriously look into a lawyer. Or at least a consult with one to see what your options are. I'd say this is serious enough to warrant legal representation. Lawyers cost money, but it may be worth it in order to save you from suspension, fines, and the accompanying hike in insurance.

Maybe look into some track days or something to address your speed jones? The street is not the place to be going that fast. Not to sound like your mom or anything, but the track is a much better (and safer) place to haul a$$ when the need strikes you. Just my opinion.

Doesn't look that way to me. I have no sympathy for you at all. Go cry somewhere else.
The only sad part of this story is that you have learned nothing and you probably never will.

101mph? Damn, thats crazy fast. I really don't see a judge letting you off with a ticket like that....they'll see getting caught doing it again as not caring about the law.

Here's a little common sense math.

140 miles at the legal speed limit of 65mph would take you 2.15 hours, or about 2 hours and 10 minutes
140 miles at 101mph would take you 1.38 hours, or roughly 1 hour and 25 minutes.

Is a $550 ticket worth shaving an extra 45 minutes off the trip?

Not flaming, just letting you know speeding doesn't always save you time...

You got caught going 101mph two times and your complaining about a 1 year suspension and $1300 fine?? Consider yourself lucky, if I was the cop I would have towed your car and arrested you on the spot for reckless op. What in the hell do you need to go 101mph for?

I am not looking for any sympathy nor do I care for sympathy! Does it look like my title states DESPERATELY NEED SYMPATHY YOU ASS????

I was driving on the 5 north.. at this time it was a 2 lane highway .. roads were almost clear.. ya gives me no right to be driving that fast.. but anyways whats done is done..

I don't see that there is anything you can do. You got caught twice doing 101 and IMHO, you deserved the punishment given to you and I don't think it's too harsh. When you get your license back after a year or so, I hope that you have learnt your lessions and be a considerate driver. Thank you.

The citation should say on its face whether an appearance is mandatory. Ordinarily I would encourage you to go and plead for mercy, but under the circumstances the judge will likely be inclined to make an example of you instead - you are an unusually juicy target for a traffic-court docket. I strongly suggest you consult with an attorney, or, if you cannot afford one, with the local Office of the Public Defender.

I think that, like last time, your attitude is awfully imperious and foolish - you make reference to the &quot;heartless&quot; policeman. Do you seriously expect to be shown mercy when you are driving 101 MPH? If, as you say, you can't afford the consequences of this, why do it? A $505 ticket would have slowed me down, but you seem to prefer to place the blame elsewhere. I think this is going to hurt, bad, and it is probably richly deserved.

Hate to say it but your chances of getting off with anything other than a large fine are slim to none and slim just left town. Best thing to do is consult a lawyer, goto court, and hope for the best. I know in Massachusetts, getting caught for 100MPH+ is automatic arrest, vehicle impoundment, and a charge of reckless driving.

I feel your pain.

This is what you do. You get contest it and go to court. That's your ONLY choice if you want to keep your license. Going to traffic school will only knock one point off your record and I'm pretty sure that if you're doin over 100 you get two points.

1. get a book on how to beat traffic violations.
2. read the relevant pages.
3. go to court and look nice.
4. perjure yourself if you have to.
5. be aggressive, but EXTREMELY respectful.

Stop thinking about yourselves and place yourself in your position, what exactly do you think you'll be doing in a case like this.... LOOKING FOR HELP, right now, he doesn't need to be scolled on since he is already going to be tried on it, so if you don't have any damn advise then don't bother coming in here saying your opinion. I'm seriously getting tired of some of you and your crap posts. He's asking for help so GIVE IT TO HIM, don't judge him more than he's already been.....you people make me sick

If this was your first offense then I could see them giving you mercy but this being your second dumbass offense then I bet your get the book thrown at you.

Are you just stupid? Yes I have gotten 4 tickets myself. I was going under 15 miles/hour in each incident. I never got a break from a cop or the judge. I don't blame them.

I am the one that exceeded the speed limit, just like you were speeding.

Take responsibility like a man and deal with it.

*Heartless&quot; cop. Whatever......Cop doing his job. With the second offense he should have taken your ass to prison for the night for going 101mph.

Dannylove, I understand where you are coming from and I know he was looking for help and I am giving him some. I am letting him know how much of a dumbass he is since the first offense didn't knock any sense into his head.

I hate to say it, but you've dug your grave and now you're going to have to own up and be buried in it. Go to court, plead your case, and hope for the best, but if you don't win, expect to pay the full brunt of the consequences.

Perchance this time, you'll learn, which may be the most valuable thing you bring away with you from all this.

Take the punishment. I'm not lawyer, but to me it looks like you don't have much of a case. Getting pulled over 2 times for going 101mph, I don't think the judges will have much sympathy for you. The cop wasn't heartless, he was doing his job. Why SHOULD he care that you're going to get your license suspended for a year. You KNOWINGLY broke the law not once, but twice. You shouldn't expect anything less punishment then what they are giving you. There's a real easy way to get out of these kinds of situations. DON'T BREAK THE LAW

Well the above is my advice to you. Take responsibility for your actions. Don't do it again.

The problem is that the way he asks for help makes it nearly impossible not to scold him. He seems, once again, to refuse to take responsibility for this. Realistically, nobody on this board can provide him any substantive assistance (Hell, I am a California attorney, but without knowing the specifics of how the county in which this happened handles traffic court, I am prostrate to help), and he is trying to avoid spending yet more money on a lawyer by getting free advice here.

There is no such thing as a free lunch, and whatever trivial assistance Kendogg can glean here is going to be balanced out by a load of criticism. If he wants unqualified legal assistance he can pay for it.

I think getting caught twice @ 101mph wasn't great, but committing perjury is a whole 'nother ballpark than a traffic violation.

heartless?? Yes, BTDT. CHPs appear willing to ticket their own grandmother, for doing 60 in a 55. Just my opinion, based on my interactions with them. (and I did hang out w/ cops a lot when I was living in CA)

My advice:
1. Hire a lawyer. The stakes are big now, so pay the bucks and bring in a pro. Saved my a$$ when I had too many, too quick.
2. Slow down! That kind of speed just begs for attention from the uniforms.
3. Read the book(s) referenced earlier on how to *avoid* tkts. (Prevention is better than the cure!!)

I'm sorry you feel that way, but what makes me sick is when people don't care about the law, break it and then expect the judge or cop to feel sorry for them. He needs to learn to take responsibilities for his actions. He shouldn't be looking for this kind of help here, anyway. He should be talking to a lawyer.

Ok, I'll admit I take dashes at 100MPH+ and have been lucky so far. I seriously think you should get legal consul other than from a bunch of computer people. The only real person I know of here that can offer real help is Frenchie.

The question danny, is whether he deserves the type of help he's asking. He's asking to be let go free of charge for speeding at 101 mph, not once but twice. If it was his first time, yeah I'll bet most of us would be willing to help him out, but the second time it gets a little dicy. What's to say he won't do it again, and again, and again? It's like the Robert Downey syndrom...&quot;I promise I'll change...just get me out this one time!&quot; Also he clearly knows he's guilty of the crime, but thinks he did NOTHING wrong and that the cards were stacked against him...

Anyways, he shouldn't expect help here, but rather in the form of a lawyer.
