Dealer wrecked some dude's 2004 Acura NSX, and they won't replace it

If that were me - They'd be replacing the car or going out of business, then buying me a new car...

Remember that little paper you sign whenever you drop your car off to be serviced? Read it.

There will be something along the lines of, "You release Joe'sDealership from any liability whatsoever. If we choose to drive your car into the nearest cinderblock wall, YOU'RE responsible. If we slaughter a pig and lock it in the car on a hot weekend with the windows rolled up, YOU'RE responsible."

Granted, negligance (sp?) isn't something that can be protected by this paper, but it sure makes the lawsuit a PITA.

Didn't that happen a couple of years ago to a guy with like an M5 or M3 or something?

Yeah, I think insurance never covers that, even if the dealership had it, so he's screwed in that department, but a guy who can afford an NSX should be able to cover it. If I bought a new 30k car it would suck too, but hey that's how it goes.

It seems to happen a lot with dealers taking cars and wrecking them.

that paper doesn't mean squat if state law says the dealer is responsible for the safe keeping of other people's property while in their possesion.

Read a little further... The tech picked up the car, no waiver was signed.

It's true... I had my car sitting on the lot (in a protected fenced in area at that) for some routine maintence. The dealership took a forklift and put a hole right through the rear bumper. They fought it tooth and nail because they have a sign posted said they were not responsible for any damage that happens on their lot

I agree with you. He didn't sign that waiver and it wasn't on their lot... It was a person representing the company, and the company should replace
