Why the hell would anyone let a dealership hack come and pick up a car like that? I barely trust a dealership to test drive my cars let alone have one of their employees drive it from my house to the dealership. Especially a supercharged NSX in the rain.

That guy is an idiot.

being reasonable? he wants a NEW car.

he is entitled to a new car. he should get his 04 repaired to factory specks. thats it. nothing more.

These type of things amaze me. People get so damn greedy.

EDIT: ok re-read (more post now!) i guess he is being reasonable. He is asking for mint condition trade in on a 05 plus his parts swaped out for free. that is fair. Doubt the dealer goes for it though.

It'd be all the same if they did some work on his car and test drove it to verify the work that they did was OK and wrecked it.

It's not uncommon for a dealer to come to your house and pick up your car...especially if it's a high-buck model.

So which is it? He is entitled to a new car, or he should get repairs only?

I know alot of guys that put MSD 6AL ignition boxes on thier cars for performance, and whenever they take it to any shop, they pop in a 3000RPM rev limiter chip. No reason a tire shop needs to go much more than that. :)

heh oops i see the mistake.

He should only get what insurance will cover. wich is the reapair of the car so he is made whole.

BUT he is asking for trade in at mint condition (only has 6k miles) on it. wich is fair since they busted it. HE is not asking for a straight cross on a 05.

To bad the dealership turned him down. the guy was being fair and really cool about it.

by law it's repairs only unless the cost of repairs exceeds the value of the car if it was in good condition

That fVcking sucks - and he's right about his depreciation. The NSX is one of the slowest depreciating vehicles in the industry - he's totally fvcked now :(

Considering their are only around 100 shops (IIRC from an older article I read) in the whole US that are certified to work on aluminum cars, and this being a 90K+ car, repairs are going to eclipse 5 figures. :(

im going to be very careful about signing papers to get work done at a dealership.

it worries me though - if you have to sign this waiver of liability for a dealership to work on your car, what recourse do you have should the dealer screw something up while fixing your car?

Well, the dealer should pony up the money to fix or replace the car then.

Lawyer or a gun...either will help 'persuade' the dealership to rectify the situation.

Keep in mind that disclaimers, signed or not, are not necessarily binding.

BTW, the guy probably isn't going insane at this point because he did say that he would be less upset if it had been his TL. I assume that means he still has his 'junker' TL to drive around for now. :p

The guy let someone else drive his car. If it was his brother, should he sue his brother for a new car? Sh!t happens, he let someone else drive the car, his insurance will pay for it and it'll depreciate. That's what happens to cars.

1. That dealership is run by idiots. If they knew what was good for them, they would have put forth every effort to fix it immediately. The bought four fcvking cars from them!
2. The deleasrship tried to play hardballl with a cool-minded fellow and it is goign to bite them in the ass for being so arrogant.
3. The car should be repaird and the trade-in value applied to a new car.
4. Becasue the depreciation is so vast, the man deserves at least the value of the car before, which is obviosuly based more on the current market value based on depreciation rather than on initial cost.
5. Why on earth should this man lose money because the dealership fvcked up, and acted arrogantly about it.

A fair thing the dealer should do is sell him a new '05, subtract the value of his '04 before the wreck, and install his parts for free.
