Mcveigh I emphasize with you and I would have gone just as ballistic on this guy which is entirely out of character for me. My kids are interracial so it outrages me when I encounter ignorant azzwipes like this too. I have gone off on a few people but no physical violence because I don't want my kids thinking that is an example to follow later in life. They are going to encounter many morons who think they are better than others because of the color of their skin and they need to know they can't fight the world.

What if find especially amusing, and this case is a prime example, is a guy like this who you stated is entirely a loser with a criminal record feels superior to this black family who undoubtedly are leading productive, normal lives and harming nobody. It must make him feel better about himself to belittle others since he's such a winner who beats his wife and breaks the law.

Even though I fail to see how this incident would fit the Chaplinsky test; considering that Chaplinsky is about 60 years old anyway, I think the court would be more likely to apply the test from Brandenburg v. Ohio (which admitedly is about 35 years old itself), which requires that speech must be directed at inciting or producing "imminent lawless action" or be likely to do so. That's a bit stricter, and it definitely wouldn't pass that test.

Besides, trying to use the law to restrict speech that offends you is, like, bad.

You're simply not right here. Profanity/racist speech, etc is disorderly conduct in many states. I was shocked myself after I did research on it. The cussing canoeist is one example of that. Sure, most of the time it is reversed, or someone is never charged with it, but it still exists.
