I don't think the 14th has ever been used in this capacity? As I asked before, what is the legal standard here for insurrection? A conviction in federal court? Simply what we saw on TV but with no due process? I'm genuinely asking.

The vast majority of people this was very specifically written to stop from being eligible were also never charged with or convicted of insurrection.
