SCOTUS WILL take up this question plus the Dumpster's immunity claim. And if they want to be taken seriously (somewhat in doubt after Dobbs), they'll find against Trump on both.

Even the folks that still love Trump are starting to realize that for any of a virtually infinite number of reasons, he's toast. If you're in doubt, just look at Haley's poll numbers.

Then we will hear for years that the Democrats where so afraid of Trump they removed him "illegally" from the ballot. I want Trump's so soundly beat at the ballot box that the bronzer gets knocked off his pompous ass face. I don't want some court making that decision.

This is for the primary too. Trump can probably still win without Colorado but it would be quite a handicap.

Interesting angle I saw on MSNBC, they were saying those in charge of the GOP might see this as a way to remove Trump using the SC. Unlikely but a possible political move.
They paused their ruling until the USSC hears an appeal leaving Trump on the ballot until then.

I agree, this isn't the right way to do it and it could really backfire in the future with red states kicking democrats of the ballot and blue states kicking republicans off the ballot. The correct way to deal with Trump is at the ballot box not through the courts. I mean if the Republicans want to nominate a convicted Felon for President, let them go down that road.
Are Democrats really that concerned that Biden is such a weak candidate that they need to legally remove Trump from the ballot before the election?
I don't love it, but this is why this clause was put into the constitution. He has already attempted to overthrow the government, we can't let him have another chance.

When was there a finding of "fact" by a jury after a trial that he attempted to overthrow the government? If he attempted to overthrow the government then he should be charged with such a crime in Federal court.

I don't think the 14th has ever been used in this capacity? As I asked before, what is the legal standard here for insurrection? A conviction in federal court? Simply what we saw on TV but with no due process? I'm genuinely asking.

I just don't like what road this sets us upon.

This case will be appealed to the USSC at warp. Question: Republicans on this court claim to be originalists. I'm included that section below. The framers created this to stop the very thing Trump did. Is there any way originalists could overrule Colorado's SC and still claim originalism? COSC rules Trump is an officer and incited an insurrection. Text below seems pretty clear to me.

Section 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may, by a vote of two-thirds of each House, remove such disability.

This is not required by the 14th, nor is it required for individuals to have seen it and know it.

The vast majority of people this was very specifically written to stop from being eligible were also never charged with or convicted of insurrection. Just because our justice system is slow as fuck doesn't mean we should let someone that is obviously hell bent on ending American Democracy have a second chance at it.

What if a purple state with a Republican leaning state supreme court does it?

Trump obviously engaged in an insurrection the way the term is commonly understood. He attempted a coup!

As for requiring a criminal conviction that is an untenable standard that would be absurd to use - why should sovereign states be forced to rely on the interpretation of a separate sovereign to enforce their own election laws?
