Dont the police have dash cams showing your brother and not you?

my dad had to do the same thing with his younger bro. they had to request the filed picture from the arrests to verify it was him, and once he saw my uncles picture in there he gave them his address, number and everything. he spent 2 years in jail for identity theft. not just my dads, he was a scammer. i love my uncle, but that point of his life he needed to pay the price for what he was trying to get into.

the dui and arrest will have a photo with it, have the cops supply that image and verify your identity. unfortunately, your bro will go down for it.
 
When the brother was arrested, the cops took the brothers prints. The OP can voluntarily provide his prints to show that it in fact was not him that was arrested.

If the OP stated that his brother's fingerprints were taken, my apologies, I've overlooked that... but the assumption that fingerprints are always taken when someone is ticketed or charged with DWI is complete crap. You've repeatedly said that, oldsmoboat, but it's not true for all jurisdictions, so stop. Photos, however, are almost always taken, which would clear things up except in the case of exactly identical twins.

Also, background checks are not (usually) free, Rastus. Perhaps in some jurisdictions, but not all.
 
The only real proof would be if the brother was charged for providing the false ID to the police, which is what should have happened.

If that happened, those records would be readily available from the Clerk of Court for 10 bucks or so.
 
Why does everyone think they get fingerprinted and photo'd when they are arrested? Here we don't fingerprint or photo for any misdemeanor except for a select few.(off the top of my head only assault on a child under 12 and assault on a handicapp)

Can I take you to jail for not carrying you license, yes. Do I, no. Really, you want me to take you to jail because I pulled you over for a seatbelt and you forgot your license? Yes, DMV has your picture. No, I can't get it in the car.

If the person refuses to sign the paper; the LEO will take them into custody.

Criminal background checks are free. Just walk into any police station and ask the desk sargent for it.
Depends on the state, here you have to go to the court house and that will just get you that county.

Guys, things happen differently in each state and even between different departments within that state. We don't fingerprint for DWI unless it is a felony. Heck, we don't fingerprint at all unless it is a felony except for a small handful of charges. What I say is valid in NC. It can and will work completely differently in other states.

Except, the OP is in Erie county in NY. Fingerprints are taken for DWI.

Exactly - everybody I've ever known who has gotten a DWI / DUI in NYS / Erie county was fingerprinted. Given what his brother did, OP could probably get his brother charged on identity theft for lying to the cops.
 
Its already taken care of in the courts. That means all the fingerprints and mug shoots are already taken out of my name. I am looking to get records to prove it to my parents not the courts.

If everything was taken off of the OP's name in court, why are those documents not available?

Your auto insurance company has the info you want unless it was really a long long time ago.

When your brother used your name for the DWI, it will have been reported to the insurance company. If the courts later corrected it, the insurance company will have done so too. I.e., their records should show the DWI originally turning up in your name and then later being removed (and they'll know the reason for this change/correction, it'll be documented).

Basically the same for the speeding tickets. The insurance company records will show they were issued in your name, so your parents can't deny their existence.

For everyone saying fingerprints or mugshot

I already took care of it with the courts I need to find proof for my parents so I can prove it to them. Look at page 2 my first or 2nd post there.

Fingerprints and mugshot are for courts.

After talking to a friend they said that I can get the case folder or whatever and it will state what he was charged with in t here so then I can get it and cram it down my parents throats. (once again read page 2 to find out why I would say that.)
 
Have you tried searching court records? Regardless, somehow I'd be surprised if all that happened and your car insurance didn't blow a hole in the ozone.

Thanks for the recommendations. I am def going down to the court office. Do they move all of them to a central location or is all separite. Like do I have to know where it happened at or can I just go to buffalo to get them. (or where are they moved all the old files
 
My little brother did the same thing. Was in his jeep speeding. Got pulled over and got tickets for no drivers license, no insurance and of course speeding. So what did he do? Since he had warrants already out for him he gave the cop my name. So a few months later I get a letter from the DPS stating that there are warrants for my arrest for not showing up in court. News to me of course. And me being the dumb-ass that I am, paid for the tickets so he wouldn't go to jail. Ruined my insurance record, also had to pay money to state for 3 years on top of the fines for pleading guilty to not having insurance at the time (state law in Texas now), which of course was not true. Just got through paying for all of this. Would I do it again? Nope.

Anything that is good enough for the courts should be good enough for your parents.

Though honestly, it sounds like you have some sort of vendetta against them. This is not healthy. If they're pricks who don't believe you, fuck 'em. You don't have to have any type of contact with them.
 
your right they do have a picture but he looks just like me plus 20lbs. people misstake us all the time. this story is true and prove is in how many people stated that they had the same thing happen to them. I can assure you not everyone is lieing that would be a pretty big stretch. and 2nd why would someone lie about this. 3rd I came here looking for help I'm not the type of person to get help for a fake problem. Look at all my post they all end with the same thing. Thanks I appreciate the help bla bla bla you get the point.
