Brother put 2 speeding tickets and a dwi in my name

Just as the title states. My A-hole of an older brother gave my name and date of birth when he got pulled over. He placed 2 speeding tickets and a dwi. Now this happened some time ago and it seems as if everyone has lost there memory because now no one believes me that he put the speeding tickets in my name.

He didnt have a licence and he was driving drunk he got pulled over and they arrested him. Thats where the dwi and one speeding ticket came from. 2 weeks later hes driving on his suspended licence again and he gets pulled over and places a 2nd speeding ticket in my name.

Now that my parents are stating that the speeding tickets never excisted that I am making it up and that I need proof. Where can I get proof from. I have looked all over the place for free criminal records information and I cant find any that are free. I would prefer not to spend anything.

When I confronted him about it. Instead of admitting to it or deining it he stated he didnt remember what he did. Which is a lie. He just is trying to keep himself getting caught in another lie. The thing that upset me the most about this is I dont really lie about anything and as for him my mother has called him a pathological liar on multi occasions. This is only a small part to what he has put me through in my life time.

So if anyone knows of a way for me to obtain this information I would love to hear it. I always come to anandtech because of how helpful everyone is here. If theres an answer to a question you guys will have it.

I should mention I live in Erie County New York. The tickets where given in that county also. If you need information to look it up online just email you I will give you all you needs. Help me nail this SOB to the wall.

You don't even have basic records at this point.

Every traffic infraction nowadays is recorded and there will be evidence that the charges were filed against the wrong person. This will cost you money though, welcome to reality.

Get all the police records, if they're filed in your name you are entitled to them along with all videotape.
 
Call the police and get the arrest report, duh? Show up with your ID and fingerprints. Done.
 
How the heck did this even happen in the first place? It's not like an officer will pull you over and not ask for a driver's license, insurance, etc, to be used for identification. The person also always has to sign any sort of citation, etc, that they are given.
 
The more I think about this, the more I think this is complete bullshit. Correct me if I'm wrong, but a DWI requires fingerprints, no? If that is the case, wrong identity is virtually impossible.
 
The police don't just take your word for who you are when they pull you over. They run the plates and ask for ID, etc.
 
Around here that is possible but not likely. Speeding and a DWI are both traffic offenses which do not require photo or fingerprinting. Now, I don't know anyone who is going to release someone on a DWI without proof of ID but it is possible. Not all cars have dash cams. Our intoloxlizer room has a camera but it sounds like it has been a while so even that is likely destroyed at this point. What you are going to need to do to even have a chance of getting this straightened out is have you brother charged with ID theft among other charges. If you do not pursue it they will not even bother looking at your complaint.
 
Sounds a little fishy. How would they not look at his license/registration. And if he doesn't have a license/registration on him, I highly doubt that they'd just take his word for who he claims he is.

If he gets pulled over, and says he's Hugh Grant, you think they're just going to issue Hugh Grant a citation? They'll look up his info... hell.. DMV even has your picture on file... they'll look up the licence, see the pic doesnt match (unless you're identical twins) and call him on bullshit.

No clue but I have seen this exact thing gone through on one of those court shows (Judge Judy maybe?) where 1 sister was suing another sister for doing pretty much the same thing. It definitely can and does happen.

but if it's true, just call the non-emergency line of the police department that pulled your brother over and explain your situation to them. I'm sure they'd be glad to add more charges on top of the DUI.
