that would work great, but if they never had OP's on file, how would they know the brother was him again??

Clerk of court will have the records you want for a few $. Court records are public info.

Get a copy of the paperwork (as others have stated).

The LEO will have copied down info from the license and registration.
Now if he was using your license; that is a different story.

When a ticket is issued; a form is signed by the perp that implies that they WILL show up in court. If one does not show up; a bench warrant can be issued for the perp.

If the person refuses to sign the paper; the LEO will take them into custody.

So it boils down to the information on the ticket is either in your name or his (via the license). If it is in your name; then it is you UNLESS you can demonstrate that it is not your signature.

for all those "but there are fingerprints!" people, cops don't just have sets of your fingerprints on the ready just in case. they need a reason to take them in the first place. the dwi was the reason to get the fingerprints. now, on the op's record, he's got his brother's fingerprints as his own.

i think all you'd need to do is go to the courthouse, tell them that you have things on your record that you never did. get copies of all the paperwork (tickets with signatures as well as lots of things with your own signature dated before and after the events in question), a new set of fingerprints for your record, and hire a lawyer to get it expunged from your records. bill it all to your brother.

fingerprint comparison equipment/software is extrememly exspensive and shitty

you would be out on bail for a DWI WAY before they would even get results on a search

Didn't they take photos when the po po booked him? If the smoking gun can get them... you can too. Unless he is your identical twin... then you are screwed.

Its already taken care of in the courts. That means all the fingerprints and mug shoots are already taken out of my name. I am looking to get records to prove it to my parents not the courts.

Because people are having a hard time seeing this.... :p

They don't care what name you give them, they care what name is on your ID.

So your brother has an ID in your name?

I would've kept every scrap of information through the whole ordeal in the first place. You never know when you'll need proof of the incident in the future when someone steals your identity.

He didnt have a licence and he was driving drunk he got pulled over and they arrested him. Thats where the dwi and one speeding ticket came from. 2 weeks later hes driving on his suspended licence again and he gets pulled over and places a 2nd speeding ticket in my name.

OP and brother must look enough alike that they beleive it was OP. Not that they(LEO's) probably cared enough anyways! I see all sorts of stuff fall through the cracks because the arresting officer isnt paying attention to detail

When the brother was arrested, the cops took the brothers prints. The OP can voluntarily provide his prints to show that it in fact was not him that was arrested.
