I pretty much agree with everything. I've seen this picture floating around. I have no idea what those guys were up to however I do feel voting stations are sacred and nobody should be milling around the entrance with any agenda other than voting and saying a brief hello to a neighbor. That doesn't mean someone can hold signs and such they simply should be well away from the entrance.

Again I have no idea what these guys were up to they may have been leaving after voting but anything else and they should be told to take it across the street.

I also find it troubling the defendants entered into a plea with the govt, and the govt appealed the sentencing. IMO if a defendant and state enters a plea, both sides should waive rights to further appeals, not just one side. 1 year in jail for burning 140 acres of public land should had satisfied the govts position. To appeal that is spiteful.

Well their main holding is that the district judge sentenced them illegally (below the mandatory minimum). He did so with the argument that the mandatory minimum was unconstitutional, which is what the appeals court found to be wrong.

While I agree that 5 years as a minimum for this sentence seems high, it's certainly (and unfortunately) not out of line with punishments we give for much less serious crimes like selling drugs. Arson carries with it serious risk to life and property far in excess of any drug sentence, so if those aren't unconstitutional it's hard to see how this would be.

To me the real answer is that we should drastically reduce prison sentences for basically every crime. That doesn't mean that these guys get a special waiver though.

While I agree with your sentiment, I thought the court's opinion on this was pretty persuasive. The Hammonds argued that there was an implicit waiver of the right to appeal that's part of the plea. I don't know about you but situations where we start implicitly waiving rights to court access sound like a bad idea to me. Imagine if the situation were reversed: say that the Hammonds only plead guilty due to some egregious government misconduct of some sort. Should their right to appeal have been considered to be implicitly waived?

Reading some of the longer backstory on this family and their run-ins with the law/BLM I can't say I'm very sympathetic to their (arguably) improper sentence being appealed by the justice department.

As to the morons that have attached themselves like parasites to this for their own attention whoring I say wait them out then come back 6 months later, arrest everybody involved, and prosecute them to the fullest extent of the law.

Having personally seen the destruction wildfires have wrought on homes, towns and resources, I think 5 years may be too light.

From everything I've read the Hammonds want nothing to do with this action and are willing obey the courts. These assholes just showed up to start crap using this as an excuse.
