Holding a person without bail and without reason is unconstitutional. What lawyer that went to school in the US would argue otherwise?
Sixth Amendment (Amendment VI) to the United States Constitution ensures people with right to a speedy trial.
How does the government think they can get around the right to a speedy trial? Does being an illegal immigrant mean you do not get the same rights as everyone else?
The first line of the Declaration of Independence says "All men are born free and equal, and have certain natural, essential, and unalienable rights". There are no mentions that "only" citizens of the US have those rights, the words are "all men" (meaning all people, not just "men").
