any laws on the topic? I was sent the wrong item from a business via mail, do I have to ship it back?

If they send you a USPS label, slap the label on it and stick out by your mailbox. After that, your job is done.

If you don't plan on keeping the TV, then slap the shipping label on the view screen and stick it on your front porch without packaging. tell them to call ups to pick it up and it can be found on your front porch. the company is retarded, they should have set processes in place to prevent stuff like this from happening. i would never ever buy from this company.

What the fuck is wrong with you? The company screwed up, the OP is an asshat, and the situation is a mess. It doesn't give him a right to destroy property that isn't his.

I bought a wall mount in addition to the 32" and needless to say I did not receive that either. My first conversation went something like this:

hi I'd like to check the status of order XXXXXXXX

it says here that your order has been canceled.

cancelled? why?

let me check... it appears that we sent you the wrong item, so we've canceled the transaction and given you a full refund. (the rest of the story is already posted)

OK, you know you lied to us at some point, right?

Your first post in this thread said this:
The company now demands that I ship the item back and is willing to pay for the shipping cost

Your third post in this thread, a half hour later, said this:
Ok interesting twist... I just called the CSR of this company and he said they've refunded the price I paid on the 32" and reinforced that they want the 46" back.

And now you say this:
My order was canceled before I made any mention of myself trying to keep the TV.
And this:

Your initial posts indicate unambiguously that they asked for the TV back, then in a subsequent call they told you that they canceled your order and refunded your money. They also strongly imply that you refused to return the TV prior to the second conversation ("and reinforced that they want the 46" back"). How can you say now that it was in your first conversation that they told you your order was canceled?

If you're going to lie on the Internet, you need to keep your story straight.

The company should send whatever carrier they use to the OP's place to pickup the thing. Most people I know don't have a vehicle that can carry a large item like this.

OP later posts that he called and they canceled the order and want the TV back

Now OP says it was in his first conversation with them that they said they canceled his order.

You are still correct, in the first instance I was notified via my paying email address. The second was when I first contacted them hoping to still get my wall mount.

send them an email with a spider drawing and say that you value the spider at the same value of a 46 inch tv.

Should he sleep with it, maybe make love to it?

Where does his responsibility lie? should he have to take the pos to the post office, fuck no. If they give him a USPS label then fuck them.

The best thing would be to call them up, tell them that it's too much hassle to send it back, and get a deal on it. Tell them you'll split the difference in the two screens with them. You get a sweet deal on a bigger TV, they get to avoid heavy duty shipping costs and lose a minor amount.

What are you, 12? Why not have some personal responsibility and either ask them nicely to send a UPS truck or something like that?

Nah, I'll just be a fucking brat and ruin something that isn't mine. Jesus H. Christ people are retarded these days.

And what if they don't send a UPS truck? Enlighten us on what we retarded people should do in that case.

If you actually make a good faith effort to return the product and the store is not accommodating, then keep the TV. You are not responsible for carrying the TV on your back and hitchhiking to the warehouse, you just have to make it available for them to reclaim.

He hasn't done anything wrong YET. He is having a moral dilemma and his little devil on the left shoulder is talking at the moment. That does not mean he won't do the right thing in the end.

We ALL agonize over moral dilemmas.

There is no moral dilemma. Only a legal dilemma of how to get the company to give him the TV with lest amount of effort. If you think the company would do anything less if the place are revesed your a fool.

Make them come in person to pick up the TV and charge a storage fee.

All the company had to do was say hey we will agree to ship you a 32" via a courier service and set it up for you and they will pick up the 42" while they are there, in this instance the OP wouldn't of been inconvenienced in the slightest manor and both parities would win but the company played a little hard ball and the op did too so one will lose. Probably in this case the company since they shipped it USPS.

Oh, it was sent USPS then thank them for the gift and ask when the TV you ordered is going to show up.

Why does it being shipped USPS matter?

If it ends up in civil court, that's probably not going to fly.

If they sent him a 24" instead of what he ordered, would you expect him to be able to keep them both?
